Recent Changes in Laws Regarding Credit Cards

I am as equally perplexed as Harvard Law Professor Elizabeth Warren regarding the contracts that now exist concerning the acquisition and use of a credit card. What used to be a contract that was approximately 1 1/2 pages long are now 15 to 30 times that. We have consumer protection laws on the books that regulate and protect us from the ingredients in the food we eat to the furniture we buy in our homes, but prior to 2009, little if any regulation or concern existed regarding the standards used by credit card companies in providing consumers with credit and then the manner in which interest charges were incurred. Given the abuses rendered by credit card companies, Congress enacted and President Obama signed into law the Credit Card Accountability Responsibility and Disclosure Act of 2009 (also known as the Credit CARD Act of 2009). See http://www.creditcards.com/credit-card-news/assets/credit-card-act.pdf.

An excellent discussion outlining the changes in the way that credit card companies may be able to increase credit card interests rates are set forth in http://www.creditcards.com/credit-card-news/help/what-the-new-credit-card-rules-mean-6000.php

I have five (5) children all of which have now graduated from college. One of my children while in college came to me with an offer she had received from a credit card company while she was in college that provided her with a credit limit of $19,000.00 at a time when she had no job and no prospect of a job while she was attending college. I told her that there are times in which applying for credit was a necessary part of life, e.g., the acquistion of a college education; the purchase of a home; and the purchase of durable goods that last longer than 3 years such as a washing machine and dryer and/or a car. However, many people become enslaved by credit "Masters" by charging such things as their groceries on a credit card or other nondurable goods only to have enormous interest charges racked up thereafter.

Imagine going into a store and observing a "blue light" special where the store announced that everyone in the store could purchase an item for X dollars, but for you ... the items would cost you X dollars plus 25% or more!!! Most intelligent beings would run not walk out of the store under such a pretense. However, that's exactly what happens in many cases when we purchase items with a credit card!

What we all need is a dose of reality here. There are many people who tout themselves as financial consultants, but it is up to us to research as consumers those individuals and carefully select one who will help us in our financial planning. Fail to plan, plan to fail. Hence, consider carefully your plans when it comes to your financial future and the acquistion and use of credit.

Another Testimony of the Effects of Texting While Driving

Although the Federal Government has recently issued regulations prohibiting drivers from texting while driving commercial motor trucks and buses, it is up to the individual states to issue laws prohibiting such conduct involving noncommercial motor vehicles. As noted in the aforementioned video, death and mayhem are the results of texting while operating a motor vehicle. Texting and driving do not mix, and legislators in those states that do not consider this activity "illegal" should reconsider their stand on this issue given recent studies published which establish that one texting while driving is 23.2 times as likely to become in a crash or near crash incident. Toyota Temporarily Suspends Sales of Selected Vehicles

Toyota.com reports:

TORRANCE, Calif., January 26, 2010 - - Toyota Motor Sales (TMS), U.S.A., Inc., today announced that it is instructing Toyota dealers to temporarily suspend sales of eight models involved in the recall for sticking accelerator pedal, announced on January 21, 2010.

“Helping ensure the safety of our customers and restoring confidence in Toyota are very important to our company,” said Group Vice President and Toyota Division General Manager Bob Carter. “This action is necessary until a remedy is finalized. We’re making every effort to address this situation for our customers as quickly as possible.”

Toyota announced it would recall approximately 2.3 million vehicles to correct sticking accelerator pedals on specific Toyota Division models. Toyota has investigated isolated reports of sticking accelerator pedal mechanisms in certain vehicles without the presence of floor mats. There is a possibility that certain accelerator pedal mechanisms may, in rare instances, mechanically stick in a partially depressed position or return slowly to the idle position.

Toyota’s accelerator pedal recall and suspension of sales is confined to the following Toyota Division vehicles:

2009-2010 RAV4,
2009-2010 Corolla,
2009-2010 Matrix,
2005-2010 Avalon,
Certain 2007-2010 Camry,
2010 Highlander,
2007-2010 Tundra,
2008-2010 Sequoia

No Lexus Division or Scion vehicles are affected by these actions. Also not affected are Toyota Prius, Tacoma, Sienna, Venza, Solara, Yaris, 4Runner, FJ Cruiser, Land Cruiser and select Camry models, including all Camry hybrids, which will remain for sale.

Due to the sales suspension, Toyota is expected to stop producing vehicles on the following production lines for the week of February 1 to assess and coordinate activities. The North America vehicle production facilities affected are:

• Toyota Motor Manufacturing, Canada (Corolla, Matrix, and RAV4)
• Toyota Motor Manufacturing, Indiana (Sequoia and Highlander)
• Toyota Motor Manufacturing, Kentucky – Line 1 (Camry and Avalon)
• Subaru of Indiana Automotive, Inc. (Camry)
• Toyota Motor Manufacturing, Texas (Tundra)

No other North American Toyota vehicle production facilities are affected by the decision to stop production.

The sticking accelerator pedal recall is separate from the on-going recall of Toyota and Lexus vehicles to reduce the risk of pedal entrapment by incorrect or out of place accessory floor mats. Approximately 1.7 million Toyota Division vehicles are subject to both separate recall actions.

Owners of the aforesaid recalled vehicles should immediately take their vehicle to the nearest Toyota dealership for repairs to the accelerator pedal. If your accelerator pedal "sticks" consider the following:

--If you need to stop immediately, the vehicle can be controlled by stepping on the brake pedal with both feet using firm and steady pressure. Do not pump the brake pedal as it will deplete the vacuum utilized for the power brake assist.

--Shift the transmission gear selector to the Neutral (N) position and use the brakes to make a controlled stop at the side of the road and turn off the engine.

--If unable to put the vehicle in Neutral, turn the engine OFF. This will not cause loss of steering or braking control, but the power assist to these systems will be lost.

--If the vehicle is equipped with an Engine Start/Stop button, firmly and steadily push the button for at least three seconds to turn off the engine. Do NOT tap the Engine Start/Stop button.

-- If the vehicle is equipped with a conventional key-ignition, turn the ignition key to the ACC position to turn off the engine. Do NOT remove the key from the ignition as this will lock the steering wheel.

New Federal Ban on Texting While Driving Commercial Trucks and Buses

CNN.com reports:
Drivers of commercial trucks and buses will be prohibited from texting under federal guidelines that U.S. Secretary of Transportation Ray LaHood is issuing Tuesday.

"We want the drivers of big rigs and buses and those who share the roads with them to be safe," LaHood said in a statement. "This is an important safety step, and we will be taking more to eliminate the threat of distracted driving."

The prohibition is effective immediately. Truck and bus drivers who text while driving commercial vehicles may be subject to civil or criminal penalties of up to $2,750, the Department of Transportation said in a news release.

The release did not offer specifics on how the prohibition will be enforced.

Cracking down on distracted drivers has been a focus of LaHood's since he took office last year.

In September, he convened a two-day summit on the issue in Washington. The Department of Transportation recently launched the Web site distraction.gov to raise awareness of the dangers of distracted driving. And this month, LaHood and National Safety Council President Janet Froetscher announced the creation of the advocacy group FocusDriven, a nonprofit that supports the families of distracted driving victims, modeled after Mothers Against Drunk Driving.

According to the Federal Motor Carrier Safety Administration, drivers take their eyes off the road for an average of 4.6 seconds out of every six seconds while texting. FMCSA research shows drivers who text are more than 20 times more likely to get in an accident than nondistracted drivers.

Nineteen states, plus the District of Columbia and Guam, have passed laws banning texting while driving. Six states, plus the District of Columbia and the Virgin Islands, ban the use of handheld devices while driving.

This regulation is long overdue. Now it is time for Idaho to join in passing legislation that will bar texting while operating a noncommercial motor vehicle to promote a safer environment on our public highways and streets.

Idaho woman faces civil complaint by Attorney General's office

KTVB.com and the Associated Press report:
JEROME, Idaho -- The Consumer Protection Division of the Idaho Attorney General's Office has filed a civil complaint against a southern Idaho woman who authorities say duped illegal immigrants in a scheme to steal their money.

Officials in a complaint filed last week say Celia Perez posed as an attorney and sold services advertised as immigration and naturalization consultation.

The complaint charges Perez with five violations of the Idaho Consumer Protection Act and its rules. State officials say Perez took thousands of dollars for services that were never performed.

The Times-News reports Perez has not yet filed a response to the complaint.

She could not be reached on Sunday by The Associated Press.

The complaint seeks civil penalties, restitution, fees and costs.

In Idaho it's easy to determine whether someone is licensed to practice law in this forum. The Idaho State Bar provides access free of charge to the public to a website at http://isb.idaho.gov/licensing/attorney_roster.cfm to determine whether a person is a licensed member of the Idaho State Bar, and whether the attorney has an "active" license or whether the status is suspended or disbarred. Membership in the Idaho State Bar is mandatory for every licensed member of the bar in this jurisdiction. It is illegal to practice law in this state unless one is licensed to do so.

Don't fall victim to someone claiming to be an attorney. Check out their credentials first before setting up a consultation.

Seat Belt Use Rose in 2009 to 84%

According to the National Highway Traffic Safety Administration (NHTSA) seat belt use rose from 83% in 2008 to 84% in 2009. The use of seat belts has been rising since 1994 accompanied by a steady decline in the percentage of unrestrained passenger fatalities during the day time. Seat belt use for occupants traveling on the weekends increased to 86% in 2009 (an increase from 83% in 2008). Selt belt use continues to be higher in states whose vehicle occupants can be pulled over solely for not using seat belts. States with primary enforcement selt belt laws including Alabama, Alaska, California, Connecticut, Delaware, District of Columbia, Georgia, Hawaii, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maine, Maryland, Michigan, Mississippi, New Jersey, New Mexico, New York, North Carolina, Oklahoma, Oregon, South Carolina, Tennessee, Texas and Washington. As of May 31, 2009, primary laws were in effect in 26 states and the District of Columbia and 23 States had secondary laws and 1 state (New Hampshire) had no seat belt laws for adults. Primary enforcement seat belt laws in Arkansas, Florida and Wisconsin did not take effect until June 30, 2009. Minnesota's primary law took effected in June 9, 2009.

It's time for Idaho to consider whether the lives of it's citizens are as precious as those elsewhere. It really isn't about "freedom" as it is an issue of public safety. The cost of failing to where a seat belt is tantamount to a decision of life and death, the cost of which is born by more than the driver and occupants of the vehicle who chose not to wear seat belts in violation of the law.

BURLEY -- Rupert police say a 45-year-old Rupert man died after his bicycle collided with the side of a truck.

- Obey all traffic signs and signals;
- Ride defensively;
- Know the rules of the road applicable in your area regarding the operation of a bicycle;
- Avoid road hazards; and
- Wear bright color clothing while operating a bicycle.

Artillery Device Found Near Green Belt

KTVB.com reports:

GARDEN CITY -- Police shutdown about 200 yards of the Boise Greenbelt today as a precautionary measure after learning that an old artillery ordnance device had been found.

A treasure hunter with a metal detector found the device just a couple yards away from the pavement near 47th Street in Garden City.

Garden City Police alerted the Boise Police Department Bomb Squad which removed the device with a robot. The device was taken to Mountain Home Air Force Base for destruction.

Police believe the device had been buried along the river for many years and suspect that it may have been left over from the Fort Boise days.

According to police, every few years old artillery devices of this nature are located somewhere throughout the Treasure Valley.

The discovery resulted in a three-hour closure of the Greenbelt. It opened again shortly after noon. There were no injuries to report.

This story is alarming because of the obvious risk to the public. We continue to receive reports of abandoned artillary devices around old military proving or exercise grounds. Children and adults alike should be instructed not to touch these devices as they are particularly dangerous and in many cases unstable. The picture above is not the picture of the device found in Garden City but is an artillary device shown to illustrate that these devices appear innocuous, but are in fact potentially lethal. Authorities should be immediately contacted if any such device is found.

Huntington Meat Packing, Inc. Recalls 864,000 lbs. of Beef Due to Possible E-Coli Contamination

Huntington Meat Packing Inc., a Montebello, Calif. establishment, has recalled approximately 864,000 pounds of beef products that may be contaminated with E. coli O157:H7. The following products, consisting of all ground beef products produced by the plant from January 5, 2010 to January 15, 2010, are subject to recall:

40 lb. boxes of "Huntington Meats Ground Beef"
40 lb. boxes of "HUNTINGTON MEAT PKG. INC. BEEF GROUND FOR FURTHER PROCESSING"
40 lb. boxes of "BEEF BURRITO FILLING MIX"
10 lb. boxes of "IMPERIAL MEAT CO. GROUND BEEF PATTY"
20 lb. boxes of "IMPERIAL MEAT CO. GROUND BEEF PATTY"
10 lb. boxes of "El Rancho MEAT & PROVISION ALL BEEF PATTIES"

Each box bears the establishment number "EST. 17967" inside the USDA mark of inspection on a label. The products were produced between January 5, 2010, and January 15, 2010, and were shipped to distribution centers, restaurants, and hotels within the State of California. FSIS has received no reports of illnesses associated with consumption of these products. Individuals concerned about an illness should contact a physician.

Consumers should only eat ground beef or ground beef patties that have been cooked to a safe internal temperature of 160° F, whether prepared from fresh or frozen raw meat products.

Color is NOT a reliable indicator that ground beef or ground beef patties have been cooked to a temperature high enough to kill harmful bacteria such as E. coli O157:H.

The only way to be sure ground beef is cooked to a high enough temperature to kill harmful bacteria is to use a thermometer to measure the internal temperature.

Refrigerate raw meat and poultry within two hours after purchase or one hour if temperatures exceed 90° F. Refrigerate cooked meat and poultry within two hours after cooking

Consumer questions regarding the recall should be directed to the company owner, Robert Glenn, at 888.894.8242.

Road Rage Results in 2 Yr Old Being Shot in the Leg

King5.com reports:
TACOMA, Wash. – A 2-year-old child was shot Sunday afternoon in what police are saying was a road rage incident.

Police say the incident occurred at about 2 p.m. on E. 56th St.

Police say the girl was riding with her parents when her parents believed another driver cut them off. Her father reportedly retaliated, and cut off the other vehicle.

"Then the second driver fired a handgun into the vehicle, striking a 2-year-old, who was sitting in a car seat in the back seat of that vehicle," said Mark Fulghum of the Tacoma Police Dept.

Police say the second driver took off.

The family drove away and got into a fender-bender.

The Tacoma Fire Department confirmed that they responded to the scene and transported the injured girl to the hospital, where she is recovering.

"All we have is a vague description of the driver of the vehicle described as a Pacific Islander, male, possibly Samaoan, and driving a black Ford Explorer, brown trimmed," said Fulghum.

No information on the license plate is available.

All of this happened on what police say was the little girl's second birthday.

A study by the AAA Foundation for Traffic Safety shows that 45,000 Americans admit to driving aggressively. If upset or frustrated, some of those drivers act out their anger behind the wheel, trying to cause harm to another driver. It’s called road rage.

We all get frustrated at times when we are behind the wheel. But there are a number of cases where aggressive driving have resulted in someone getting killed.

The following are 10 safety tips to consider to avoid road rage or if you are confronted with an aggressive driver.

1. Put yourself in the other driver's seat. Maybe the other driver has to go to the bathroom; maybe the other driver is driving impaired; maybe the other driver is reacting to an emergency; maybe the other driver is lost in thought due to a traumatic experience at work or home.

2. Act - Don't React. Don't retaliate when confronted by someone driving aggressively by yelling, screaming, giving "hand" gestures or otherwise driving your vehicle in a manner that could be considered aggressive. Let the other driver go. The risk of harm to yourself and others is not worth the satisfation of venting.

3. Use Restaurant Etiquette While Driving. Act in your car as if you were in a restaurant. We all experience other people being rude, but would we react the same way if we were in a restaurant, grocery store or better yet at work? Likely not.

4. If confronted by an aggressive driver, slow down, be prepared to change routes and keep your cool.

5. Your horn and lights aren't designed to be used to retaliate when confronted by an agressive drive; they are safety devises and to be used not abused to avoid an accident. An occasion use of the horn to alert the other driver of your presence is one thing; laying on the horn aggressively is another which could ingnite the other driver's anger.

6. Avoid texting and/or using a cell phone while driving. Distrations in a vehicle are the number 1 cause of motor vehicle collisions.

7. Give yourself more time to travel. Set your watch ahead to avoid having to rush while driving to your next destination. Many times we are rushed due to our own mismanagement of time.

8. Be courteous, calm and collected.

9. Avoid operating a motor vehicle when we are emotionally impaired. If you are distressed about something, take 5 minutes to collect yourself before getting behind the wheel of a car.

10. Plan ahead and drive defensively. Don't drink and drive. Follow the rules of the road when operating a motor vehicle, and use good common sense.

FDA Recalls Two Veterinary Drugs Found Harmful to Cats

Two veterinary drugs made by Teva Animal Health Inc. a division of Israeli-based Teva Pharmaceutical Industries were recalled by the FDA, however, few veterinarians or pet owners are reported to be aware of the recall. Although there are reported five deaths of cats that led the FDA to issue public recall notices on Dec. 22 and Dec. 29, 2009, just what products are involved and over what time period they were manufactured and sold remains unclear. The recalls involve two commonly used injectable veterinary drugs: butorphanol a fast-acting opioid used to control pain from surgical procedures in dogs and cats and the anesthetic agent ketamine. Ketamine is part of a "cocktail" of drugs that induces anesthesia in animals including dogs and cats. It can be used usually with valium prior to surgery a dental cleaning and sometimes as a form of restraint for procedures such as an imaging scan. It's not the only drug that can be used in this way but it's one of the most common. The only explanation so far given as to just what's wrong with the recalled ketamine came in a press release issued by the FDA on Dec. 22 which said "This recall is being conducted as a result of an increased trend in serious adverse events associated with this product including lack of effect prolonged effect and death." Because pets are anesthetized more often than humans -- for example nearly all dogs and cats are spayed and neutered at a young age -- the potential number of affected animals is huge. Although it was the nation's largest manufacturer of generic animal drugs almost no one in the veterinarian community had heard of Teva Animal Health until the FDA shut it down on July 31 citing adulterated drugs and multiple violations of good manufacturing practices at its St. Joseph Mo. facility.
