Play Yards with Bassinets Recalled Due to Risk of Suffocation







Dorel Juvenile Group Inc., the manufacturer of various Play Yards with Bassinets, has issued a recall of said products, because the one piece metal bar supporting the floorboard of the bassinet attachments can come out of the fabric sleeve and create an uneven sleeping surface creating a risk/hazard of position asphyxiation or suffocation. The products are sold under a variety of names including Safety 1st Play Yard; Disney Care Center™ Play Yard and Eddie Bauer Complete Care Play Yard. The play yards are portable and were sold with a bassinet attachment and a built-in changing station. Models included in this recall are 05025, 05026, 05037, 05088 and 05350. The model number is printed on a sticker on one of the support legs underneath the play yard. “Safety 1st” or “Eddie Bauer” are printed near the bottom of the fabric sides of the play yards. The products were sold at Babies “R” Us, Kmart, Sears, Target and Walmart from January 2007 through October 2009 for between $100 and $130. Consumers should immediately discontinue using the bassinet attachment to the play yard and contact Dorel Juvenile Group for a free repair kit including replacement bassinet fabric, bassinet bars and installation instructions. Home Safety Vacation Tips and Checklist


The following tips and safety checklist are provided to those headed on a family vacation to protect your home and property while you are gone complements of the Boise Police Department:
Often residential crime occurs when we are away from home on a family vacation or are involved in outdoor activities. How can you protect your home and property when you are gone? Remember, your goal is for your home to appear lived in. You want it to look different in the morning than at night. Follow this check list to secure your home:

•Inform as few people as possible of your vacation plans. This includes newspaper and postal delivery people, unless you are going to be gone an extended period of time.

•Ask a trusted neighbor to keep an eye on your home while you are gone and to report any suspicious or criminal activity to the police department.

•Give emergency telephone numbers, your itinerary, and a house key to your trusted neighbor.

•Ask them to pick up your newspaper, mail, and other deliveries.

•Ask your neighbor to place a filled garbage can in front of your house on collection day.

•Ask your neighbor to park their vehicle in your driveway occasionally. Do all these for your neighbor when he/she goes on vacation.

•Arrange to have the lawn mowed or snow removed.

•Install dusk-to-dawn (photo cell) or motion sensor lights on all outdoor lights.

•Use automatic timers on a radio and lamps to simulate occupancy. Set these for your normal routine. For instance, a radio and lamp in the living room might be on from dusk until 10:00 PM then at 10:00 PM a lamp goes on in the bedroom and off at midnight.

•Don't change your answering machine to say you are out of town. When you are away, check your messages occasionally.

•Lock all outside doors using deadbolt locks and shut and lock your windows.

•Store valuables in a safety deposit box.

Now that you have learned some precautions to take for your home when you are away, you might want to go a step further and contact the police department for a Home Security Survey.

Mountain Man Nut & Fruit Co. Recalls Select Products Containing Shelled Hazelnuts Due to Possible Samonella Contamination


Mountain Man Nut & Fruit Co. has recalled select products containing shelled hazelnuts (filberts)in conjunction with the recall from Kunze Fams due to the fact that raw hazelnuts could have been exposed to salmonella and may be contaminated. During routine inspection of the hazelnut shelling facility one salmonella test came back positive. In the interest of the safety of our customers, Mountain Man is requesting that customers return any of the lot codes below to their place of purchase for replacement or refund.All of the below is product that would have been manufactured and packaged since November 1, 2009 and December 17, 2009. Product purchased before or after these dates should not be affected by this recall.

Cressi-sub USA, the manufacturer of the Cressi Ellipse Black MC5 Regulator, has recalled this product, because partial obstruction of the High Pressure (HP) port can produce inaccurate reading of the pressure guage resulting in a slow descent of the needle in the pressure gauage. The inaccurate reading of the pressure guage poses a hazard of drowning to the diver. Impaired Driving


This from the Center for Disease Control And Prevention (CDC):

Every day, 32 people in the United States die in motor vehicle crashes that involve an alcohol-impaired driver. This amounts to one death every 45 minutes. The annual cost of alcohol-related crashes totals more than $51 billion. But there are effective measures that can help prevent injuries and deaths from alcohol-impaired driving.

How big is the problem?

•In 2008, 11,773 people were killed in alcohol-impaired driving crashes, accounting for nearly one-third (32%) of all traffic-related deaths in the United States.
•Of the 1,347 traffic fatalities among children ages 0 to 14 years in 2008, about one out of every six (16%) involved an alcohol-impaired driver.
•Of the 216 child passengers ages 14 and younger who died in alcohol-impaired driving crashes in 2008, about half (99) were riding in the vehicle with the with the alcohol-impaired driver.
•In 2008, over 1.4 million drivers were arrested for driving under the influence of alcohol or narcotics. That's less than one percent of the 159 million self-reported episodes of alcohol-impaired driving among U.S. adults each year.
•Drugs other than alcohol (e.g., marijuana and cocaine) are involved in about 18% of motor vehicle driver deaths. These other drugs are often used in combination with alcohol.

Who is most at risk?

•Young people:

◦At all levels of blood alcohol concentration (BAC), the risk of being involved in a crash is greater for young people than for older people.
◦Among drivers with BAC levels of 0.08 % or higher involved in fatal crashes in 2008, more than one out of every 3 were between 21 and 24 years of age (34%). The next two largest groups were ages 25 to 34 (31%) and 35 to 44 (25%).

•Motorcyclists:

◦Among motorcyclists killed in fatal crashes, 30% have BACs of 0.08% or greater.
◦Nearly half of the alcohol-impaired motorcyclists killed each year are 40 or older, and motorcyclists ages 40-44 have the highest percentage of fatalities with BACs of 0.08% or greater (44%).
•Drivers with prior driving while impaired (DWI) convictions:
◦Drivers with a BAC of 0.08% or higher involved in fatal crashes were eight times more likely to have a prior conviction for DWI than were drivers with no alcohol (8% and 1%, respectively).

Polaris Industries, Inc. has recalled 2009/2010 Sportsman ATVs due to a crash hazard from thenfront suspension ball joint stem separating from the steering knuckle causing the rider to lose steering control and posing a risk of injury or death to riders. Harry and David Recall Hazelnuts Due to Risk of Salmonella Contamination


Harry and David has issued a voluntary recall of raw, shelled hazenut kernals supplied by Evonuk Oregon Hazelnuts due to possible Salmonella contamination. Salmonella is an organism which can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems. Healthy persons infected with Salmonella often experience fever, diarrhea (which may be bloody), nausea, vomiting and abdominal pain. In rare circumstances, infection with Salmonella can result in the organism getting into the bloodstream and producing more severe illnesses such as arterial infections (i.e., infected aneurysms), endocarditis and arthritis. The hazelnuts affected by this recall were sold as Filbert (hazelnut) kernels in bulk bin #10077 only at the Harry & David Country Village store, Medford, Oregon, prior to December 18, 2009. Consumers who have purchased any of the bulk hazelnuts from the Harry & David Country Village store are encouraged to return them to the store for a full refund.

Action Team Toy Dart Gun Set Recalled Due to Child's Asphyxiation Death


OKK Trading, Inc. of Los Angeles, CA has recalled the "Action Team" Toy Dart Gun Set manufactured by Kong Hoi Industrial Co., of Hong Kong, China, because of a risk that a child may place the soft, pliable plastic dart in the child's mouth which is likely to cause the child to choke or aspirate on the dart thereby impairing the child's ability to breathe. If the dart is not immediately removed, the plastic dart may cause brain injury or death. There has been at least one reported death of an 8 year old boy who was chewing on the toy dart and inadvertently swallowed it lodging the dart into the child's throat blocking his ability to breathe resulting in the death of the child. The play set has a toy gun with 3 soft rubber darts, a S.W.A.T. watch, baton, walkie-talkie and badge with a clip and an ID card. The soft, pliable orange plastic darts have a nearly 2 ½ inch long shaft and an approximately ¾ inch diameter suction cup. The toy gun is black with an orange nose and trigger and red spring release mechanism. “Made in China” is printed on one side of the barrel.

10 Holiday Safety Tips to Avoid Fire & Injury This Holiday Season


The U.S. Consumer Product Safety Commission (CPSC) reports that more than 14,000 people each year are treated for injuries in an emergency room related to holiday decorating. Each year Christmas trees involve hundreds of fires resulting in an average of 15 deaths and $13 Million in property damage. Candle-related fires also average more than 12,000 fires a year causing 150 deaths and $393 Million in property damage.

The following are ten safety tips offered by the UPSC for holiday decorating to help keep your holiday safe for your family and home this year:

Trees and Decorations

1. When purchasing an artificial tree, DO look for the label "Fire Resistant." Although this label does not mean the tree won't catch fire, it does indicate the tree is more resistant to catching fire.

2. When purchasing a live tree, DO check for freshness. A fresh tree is green, needles are hard to pull from branches and do not break when bent between your fingers. The bottom of a fresh tree is sticky with resin, and when tapped on the ground, the tree should not lose many needles.

3. When setting up a tree at home, DO place it away from heat sources such as fireplaces, vents, and radiators. Because heated rooms dry out live trees rapidly, be sure to monitor water levels and keep the stand filled with water. Place the tree out of the way of traffic, and do not block doorways.

4. In homes with small children, DO take special care to avoid sharp, weighted or breakable decorations, keep trimmings with small removable parts out of the reach of children who could swallow or inhale small pieces, and avoid trimmings that resemble candy or food that may tempt a child to eat them.

Lights

5. Indoors or outside, DO use only lights that have been tested for safety by a nationally-recognized testing laboratory, such as UL or ETL/ITSNA.

6. Check each set of lights, new or old, for broken or cracked sockets, frayed or bare wires, or loose connections. Throw out damaged sets. DON’T use electric lights on a metallic tree.

7. If using an extension cord, DO make sure it is rated for the intended use.

8. When using lights outdoors, DO check labels to be sure the lights have been certified for outdoor use and only plug them into a ground-fault circuit interrupter (GFCI) protected receptacle or a portable GFCI.

Candles

9. Keep burning candles within sight. DO extinguish all candles before you go to bed, leave the room or leave the house.

10. DO keep lighted candles away from items that can catch fire and burn easily, such as trees, other evergreens, decorations, curtains and furniture.

Snow blamed for accidents all over Treasure Valley

BOISE -- As Saturday drew on and the snow fell, the roads were progressively getting worse.

Accidents across the valley finally began to slow down, only after 12 hours of being extremely busy.

"There was a rash of crashes for awhile,” said Corporal Edward Robertson with the Idaho State Police. “We were pretty busy."

As the snow began to fall, accidents across the Treasure Valley began to pile up.

"We prepare for these types of things,” said Cortney Dennis, a supervisor for Ada County Dispatch. “We're ready to handle these types of snowfalls, but certainly, over 120 accidents in the Treasure Valley today. I know ISP was really busy as well.”

Dennis said the majority of their accidents did not have any injuries.

"A lot of fender benders, a lot of slide-offs," Dennis said.

One car with kids inside slid off the Connector and onto the duck pond near the Flying Wye.

The car went right onto the ice.

Luckily it didn't break and they were able to get out safely.

"When the first few snowfalls hit, we do see a large increase in the number of accidents until everyone kind of adjusts their driving pattern and get more comfortable with the roadways," Dennis said.

It was a busy day for Idaho State Police as well.

From 7 a.m. Saturday until 7 p.m., Ada County alone responded to 123 accidents.

Robertson said the weather is not completely at fault.

“People habitually like to blame the weather, but it's not a weather problem,” Robertson said. “It's a driving problem. And if we could
just get folks to just slow down, be courteous to each other and understand that the roads are slick.”

Ten miles east of Boise on I-84, an ISP officer was investigating an accident when a truck hit his patrol car.

"At a time when we needed all of our troopers the most, we had a trooper taken out of the game because he's now a victim of a crash," Robertson said.

Ada County Dispatch says of their 123 accidents, 76 of them did not have any injuries. Six were hit-and-runs, 20 were slide-offs and 20 of them had injuries.

Drivers are advised to drive carefully and go at speeds that are appropriate for the conditions.

Idaho Code Section 49-654(1) (referred to as the "Basic Rule" Statute) sets forth:
No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing. Consistent with the foregoing, every person shall drive at a safe and appropriate speed when approaching and crossing an intersection or railroad grade crossing, when approaching and going around a curve, when approaching a hillcrest, when traveling upon any narrow or winding highway, and when special hazards exist with respect to pedestrians or other traffic or by reason of weather or highway conditions.

The fact is motor vehicle collisions on icy, snowy or wet roads are largely due to drivers ignoring the road conditions and driving in excess of speeds that are reasonable and prudent given the hazards then existing.

1. Decrease your speed and leave yourself plenty of room to stop. You should allow at least three times more space than usual between you and the car in front of you.
2. Brake gently to avoid skidding. If your wheels start to lock up, ease off the brake.
3. Turn on your lights to increase your visibility to other motorists.
4. Keep your lights and windshield clean.
5. Use low gears to keep traction, especially on hills.
6. Don't use cruise control or overdrive on icy roads.
7. Be especially careful on bridges, overpasses and infrequently traveled roads, which will freeze first. Even at temperatures above freezing, if the conditions are wet, you might encounter ice in shady areas or on exposed roadways like bridges.
8. Don't pass snow plows and sanding trucks. The drivers have limited visibility, and you're likely to find the road in front of them worse than the road behind.
9. Don't assume your vehicle can handle all conditions. Even four-wheel and front-wheel drive vehicles can encounter trouble on winter roads.

If your rear wheels skid...

1. Take your foot off the accelerator.
2. Steer in the direction you want the front wheels to go. If your rear wheels are sliding left, steer left. If they're sliding right, steer right.
3. If your rear wheels start sliding the other way as you recover, ease the steering wheel toward that side. You might have to steer left and right a few times to get your vehicle completely under control.
4. If you have standard brakes, pump them gently.
5. If you have anti-lock brakes (ABS), do not pump the brakes. Apply steady pressure to the brakes. You will feel the brakes pulse — this is normal.

If your front wheels skid...

1. Take your foot off the gas and shift to neutral, but don't try to steer immediately.
2. As the wheels skid sideways, they will slow the vehicle and traction will return.
3. As it does, steer in the direction you want to go. Then put the transmission in "drive" or release the clutch, and accelerate gently.

If you get stuck...

1. Do not spin your wheels. This will only dig you in deeper.
2. Turn your wheels from side to side a few times to push snow out of the way.
3. Use a light touch on the gas, to ease your car out.
4. Use a shovel to clear snow away from the wheels and the underside of the car.
5. Pour sand, kitty litter, gravel or salt in the path of the wheels, to help get traction.
6. Try rocking the vehicle. (Check your owner's manual first — it can damage the transmission on some vehicles.) Shift from forward to reverse, and back again. Each time you're in gear, give a light touch on the gas until the vehicle gets going.

If you become stranded...

1. Do not leave your car unless you know exactly where you are, how far it is to possible help, and are certain you will improve your situation.
2. To attract attention, light two flares and place one at each end of the car a safe distance away. Hang a brightly colored cloth from your antenna.
3. If you are sure the car's exhaust pipe is not blocked, run the engine and heater for about 10 minutes every hour or so depending upon the amount of gas in the tank.
4. To protect yourself from frostbite and hypothermia use the woolen items and blankets to keep warm.
5. Keep at least one window open slightly. Heavy snow and ice can seal a car shut.
6. Eat a hard candy to keep your mouth moist.

Be aware of your conditions and slow down! The life you save may be your own.

Log Splitters by MTD Products, Inc. Recalled Due to Amputation Hazard


MTD Products Inc., the manufacturer of Log Splitters, has recalled its product due to the risk that the control handle of the log splitter may fail to automatically return to the neutral position causing the splitting wedge to fail to stop from moving forward posing a risk of amputating the operator's hands and fingers.

State Legislator Hit by Car Near Capitol



KTVB.com publishes the following AP Report today:

BOISE -- A southwestern Idaho lawmaker is on the mend after being struck by a car while crossing a street outside the Capitol.

Rep. Darrell Bolz, a Republican from Caldwell, says his foot is swollen but not broken after the accident at 7 a.m. Thursday on State Street, which is narrower than usual due to construction barriers.

Bolz has resorted to crutches after seeking medical attention at an urgent care facility.

Bolz was crossing in a crosswalk near the lone Capitol entrance now open to the public as work crews put the finishing touches on $120 million in renovations.

He says, "I stepped out one step and 'Wham.' I'm not blaming anybody at this point in time."

The car's driver stopped to inquire if he was OK.

Bolz didn't call Boise Police, though an Idaho State Police officer who helps supervise Capitol security has asked him to issue a statement.

Under Idaho law* any individual who is involved in a motor vehicle collision is required to notify the local police department where personal injury or death is involved and/or the property damage exceeds One Thousand Five Hundred and No/100ths Dollars ($1,500.00). The best course of action to take is to always call 911 immediately following any motor vehicle collision of any type or kind in order to protect all parties in the case in the event allegations or legal issues are raised at a later date. If you leave the site of a collision, you could be charged with a crime for doing so without calling the authorities. In cases involving a motor vehicle collision with no personal injury, death or damage involving less than One Thousand Five Hundred and No/100ths Dollars ($1,500.00) you may file a walk-in accident report with the local police agency, but again, the recommended course of action is to always call 911 and have the police perform the investigation. Even if you are at fault, such an investigation may prove beneficial to you should legal issues occur later. Leaving the scene of a collision may be a chargeable offense. As some say, "It's better to be safe than sorry."

A client of mine was involved in a motor vehicle collision and had slight pain in her neck. Fortunately for her, she decided to get checked out at a local hospital. She was found to have an unstable fracture of her cervical spine. The attending physician informed her that had she delayed in seeking medical attention, one sneeze could have left her paralyzed. Surgery commenced and the surgeon fused her affected vertebrae. Don't take chances, always call the authorities when you are involved in a motor vehicle collision.

Parenthetically, I'm grateful that the aforesaid legislator wasn't hurt worse than he was in this case. Hopefully, he will recover quickly as he prepares to take care of the people's business this upcoming legislative session.

* Idaho Code Section 49-1305 reads:

(1) The driver of a vehicle involved in an accident resulting in injury to or death of any person, or damage to the property of any one (1) person in excess of one thousand five hundred dollars ($1,500) shall immediately, by the quickest means of communication, give notice of the accident to the local police department if the accident occurs within a city, otherwise to the office of the county sheriff or the nearest office of the state police.

(2) Whenever the driver of a vehicle is physically incapable of giving immediate notice of an accident as required herein, and there was another occupant in the vehicle at the time of the accident capable of doing so, the occupant shall give or cause to be given the notice not given by the driver.

Nampa man has holiday miracle after catching on fire at a Meridian parade

Bill Loverde celebrated his 65th birthday Wednesday night with his family, an event he might have missed if not for the fast action of strangers.

On Saturday, Loverde's face, left hand and clothes caught fire while he was working on a generator atop his funnel cake stand at the Winterland Parade in downtown Meridian.

"The cap blew off in my hand and the fuel flew into my face," Loverde said. "It just happened in one split second. It blew up."

Then he either fell or jumped from the roof of the roughly 8-foot-tall trailer.

After he rolled on the ground, Loverde said he grabbed a water bottle to put out the fire.

That's when bystanders intervened, using their hands to smother the flames on Loverde.

When Meridian police Cpl. Branden Fiscus got to the concession stand, he used a fire extinguisher to put out the 4-foot flames on top of the trailer.

"It wasn't like I charged a machine gun nest or anything," Fiscus said.

Bystanders took Loverde into a nearby restaurant on Idaho Street, where a nurse used cold, wet rags to soothe the burns.

Loverde suffered second-degree burns to the left side of his face and his left hand and wrist and some scrapes and bruises from his fall.

Bob Athay of Meridian was working in his son's nut concession stand next door. He and two other men rushed to help Loverde and had to wrestle him to the ground to keep him from climbing back up the ladder to put out the fire.

"It looked a whole lot worse than it actually turned out," Athay said. "When Bill hit the ground, the left side of his face, his left shoulder and part of his left arm were on fire."

At first, Loverde was a pretty gruesome sight, said Meridian resident Erika Dennis, who said she was at the scene of the accident with her young daughter.

That Loverde survived and will make a full recovery is a "Christmas miracle," Dennis said.

No doubt Loverde was lucky, said Meridian Fire Department Chief Joe Silva.

"One of the things that really worked well here is that he covered his nose and mouth and turned away from the flames," Silva said. "Bill was lucky that he had some people instinctively do the right thing. They had to put the flames out."

Silva also praised Fiscus' fast action to extinguish the generator fire. He said the city of Meridian is looking into special recognition for the citizens who helped.

Silva said his praise of the bystanders also comes with a lesson for the public: Never put gas in a running engine. If you catch fire, the best tactic is to stop, drop and roll, Silva said.

Loverde was treated at Saint Alphonsus Regional Medical Center in Boise. Burn specialists from Salt Lake City consulted via video camera, Loverde said.

He was treated Monday at the burn center in Salt Lake City. His doctors say he'll recover 100 percent and have little or no scarring.

In the meantime, Loverde has physical therapy, pain pills and lots of ointment. He also has gratitude for the people who helped him.

"I just don't have words to thank them for what they have done," Loverde said. "It would have been a whole lot worse. The burns would have been worse and I could have been dead."

Will Loverde, Bill's son, also wanted to thank the man who kept his father from climbing back onto the roof of the trailer.

"Dad got a little upset with him and feels bad," Will Loverde said. "He wants to apologize to him."


Incidents like the one reported above happen all too often due many times as a result of defective products that are unreasonably dangerous.

There are two potential claims of relief and/or causes of action regarding this type incident. The first may be a claim for worker's compensation if the injuried party was working at the time of the accident. If a person is injured due to an industrial accident, the worker should immediately contact the Idaho Industrial Commission and complete and file a Form 1 Notice of Injury to preserve the worker's right to workers' compensation. Failure to do so within 60 days of the accident could result in a complete bar to any benefits including the costs of medical treatment, impairment and/or disability.

The second possible claim may be against the product manufacturer if the product was defective and unreasonably dangerous. The statute of limitations for personal injury in Idaho is two years from the date of the act, omission or occurrence complained of. Failure to file a lawsuit prior to the expiration of the statute of limitations could act as a complete bar to any recovery.

Unilever Issues Nationwide Recall of SlimFast Ready to Drink (RTDs) in All Cans Due to Risk of Possible Contamination



Unilever United States, Inc. has issued a voluntary recall of all Slim-Fast® ready-to-drink (RTD) products in cans due to the possibility of contamination with Bacillus cereus, a micro-organism, which may cause diarrhea and possibly nausea and/or vomiting. The products are packaged in paperboard cartons and contain four, six or 12 steel cans that are 11 FL OZ (325 mL) each. Individual cans are also sold in certain retail outlets. The recall involves all Slim-Fast® RTD products in cans, regardless of flavor, Best-By date, lot code or UPC number. No other Slim-Fast® products are affected by this recall. No other Slim-Fast® powdered shakes, meal bars, or snack bars are affected by this recall.

Consumers who have purchased Slim-Fast® RTD products in cans are urged to discard them immediately and contact the company at 1-800-896-9479 for a full refund. The Consumer Services Center is open Monday – Friday, 8:30 AM – 6:00 PM ET. A recorded message is available 24/7.
