Some Rental Cars Are Entering Used Car Lots Without Side Airbags

CBS News reports:

(CBS) Imagine buying a car only to find out that one of its safety features is missing. That's exactly what's happened to thousands of unsuspecting consumers who have purchased the popular Chevy Impala as used cars, reports "Early Show" Consumer Correspondent Susan Koeppen.

The says the Impalas in question were at one time part of a car rental fleet. The safety equipment that's missing is the side airbags.

But, as her team found out in a hidden camera investigation, many of these cars are sitting on used car lots -- up for sale -- with window stickers that claim the cars have those side airbags.

Side airbags are standard equipment on the Chevrolet Impala -- but thousands are being sold without this important safety feature.

On used car lots in three states, "The Early Show"'s hidden cameras found Impalas advertised with side airbags. However, in reality, those airbags were missing, Koeppen reported.

That's was the case when Connie Wittkopp purchased a used Impala from Enterprise in Kansas City. The paperwork said side airbags were included.

Wittkopp told Koeppen, "How could they have a clean or clear conscience knowing that they're going to sell that car to someone who could go out here and get killed?"

Wittkopp had no idea her car was part of a deal where General Motors allowed rental car companies and fleet buyers to delete side airbags at the factory to save money.

Now, more than 100,000 Impalas without side airbags are making their way into the used car market.

Sean Kane, a safety consultant from Safety Research and Strategies, a safety advocacy group, said, "In all the years of our work in motor vehicle safety, we have never seen a standard feature deleted from a car in this kind of way."

Kane said he was shocked to discover side airbags deleted and replaced with plastic. Kane said the effort saved fleet buyers $145 per vehicle.

"This was a concerted effort by General Motors to give fleet customers an option of saving $145 at the expense of safety," Kane said.

Wearing a hidden camera, "The Early Show"'s team went to several used car lots across the country that advertised the Impalas in question as having side airbags. Koeppen said they wanted to see what consumers were being told on the lot.

An "Early Show" producer asked a salesperson if one of the Impalas in question featured side curtain airbags.

The salesperson replied, "Yes, it does."

In Houston, Texas, another salesperson didn't realize the airbags had been deleted.

But Koeppen said her team knew side airbags had been when they found the deleted option code "AK5" on the vehicle identification plate in the trunk. The door trim was also missing the word airbag, which the salesperson eventually noticed.

The salesperson told "The Early Show" team, "This one actually does not have it, doesn't have the side impacts on it."

"The Early Show" producer asked, "It doesn't?"

The salesperson confirmed, "It doesn't."

In Oklahoma City, Koeppen's team found another Impala with deleted airbags, a salesperson told "The Early Show" producer that, in fact, the car did have the airbags. The car's window description listed "passengers front airbag and side airbags."

And in Providence, R.I. the CBS affiliate, WPRI, went undercover with the same result. The salesperson said at that dealership, "They said that there's airbags in there."

Kane said, "To see them being sold in dealers, in many cases unknowingly, is a really a problem that goes back to General Motors."

As for Enterprise, the company offered to buy back their vehicles for $750 over the Kelley Blue Book value, or pay $200 for the customer's inconvenience. Enterprise told "The Early Show" it would give Wittkopp full value for her car, but she's still angry.

"People's lives they're worth a whole lot more than just saving money by leaving stuff off the vehicle," she said. "No, you don't do that."

Enterprise, which admits it incorrectly listed some of these cars on its Web site for sale with side airbags, says, "We have apologized for the error we made, and we have done, and continue to do, what we can to rectify the situation with our customers."

General Motors says these vehicles "meet or exceed federal safety standards." The company no longer allows airbags to be deleted.

Koeppen added on "The Early Show" that General Motors has sent out a message to dealers saying they should change their window stickers, advertising and Web sites to reflect the airbags in the cars.

Koeppen said each dealership was told about "The Early Show" investigation and were told what the teams found. However, she said one dealership still has not changed their Impala advertising.

Koeppen advised, "So if you're buying a used car -- any used car -- make sure you do a really thorough background check on the car."

In order to avoid the risk of a catastrophic loss due to the result of a lack of a safety device (air bag) that should have been installed in a vehicle you are considering purchasing, the asute consumer should consider taking the following action before signing a contract for the purchase of a previously owned vehicle:

1. Hire an indepedent mechanic to conduct an inspection of the vehicle to insure that all safety systems are in place and functioning;

2. Ask the seller for the names, addresses and phone numbers of any and all previous owners of the vehicle.

3. Check with Carfax.com to see what information you can obtain as to whether the vehicle was previously involved in a prior collision and the history of any repairs to the vehicle.

4. You should contact your local department of motor vehicles to ask for a history of ownership of the vehicle. That will help you find identity of any previous owners of the vehicle and then contact same to see what, if any, information they may provide you to help you determine whether you want to take a risk on purchasing the vehicle;

5. Make sure that the seller is providing you in writing with a warranty that all safety devises including air bags are present and functioning;

6. Contact your local Better Business Bureau to see if there are any complaints of record against the seller; and

7. Contact your State Attorney General's Office to see if they have received or are prosecuting any complaints against the seller.

You should never purchase a vehicle without functioning air bags if the vehicle is designed to have them installed including driver's side, passenger side and side air bags.

Ice Rink Roof Collapsed Reportedly Due to Heavy Snow

Foxnews.com reports:
ROSTRAVER, Pa. — Heavy snow buildup from recent storms likely contributed to the collapse of an ice rink roof, causing a panicked evacuation but no injuries, a fire official and the building's owner said.

"We believe it was excessive weight from the copious quantities of snow that we've had over the past 10 days," Jim Murphy, who has owned the Rostraver Ice Garden since 1993, said Monday. "We believe a laminated wood truss broke and that caused two other ones to go and the roof to pancake in that area."

The region has gotten more than two feet of snow in the past week and a half. Justin Shawley, assistant chief of the Rostraver Central Volunteer Fire Company, also said snow and ice buildup may have contributed to the collapse.

A 100-foot-by-200-foot roof section fell in during a youth hockey tournament Sunday afternoon. The teams were in the locker room and only one person, a rink worker, was on the ice.

The worker heard a crack and told people to get out of the building, Shawley said. About 100 people inside the rink bolted for the exits.

There were reports of people unaccounted for amid the post-collapse confusion, but authorities searched the building with cadaver dogs and thermal-imaging cameras before declaring that no one was missing.

Murphy could not immediately estimate the cost of the damage. He said he hoped to have heat and electricity turned on so pipes would not freeze.

The rink, about 30 miles southeast of Pittsburgh, is in the middle of facility, which was built in 1965, and is flanked by a banquet hall on one side and a pub on the other. Those sections were not damaged, Murphy said. The rink will not reopen anytime soon, though the pub and banquet facilities could, he said.

An investigation in this matter will reveal the cause of the collapse of this building. Albeit heavy snows are reported to be the culprit, the fact is that buildings of the type and kind are designed by architects and constucted by contractors. The investigation will determine if the materials used in the construction of this building conformed with those specified by the architect. The questions posed in this inquiry are whether the materials used in the construction of the building conformed to the design or whether the design itself was insufficient. Conforming merely to building codes are not necessarily sufficient if it is determined that the archetect knew or should have known beforehand what the snow fall is on a 50 yr and/or 100 yr periods. Taking averages over lesser periods do not protect the public safety. Fortunately, no one was injuried in this collapse, but an investigation must be conducted in order to protect others (particularly children) who use facilities such as the type and kind involved in this collapse from potential catastrophe.

Salmonella Outbreak Linked to Black Pepper Sold by Union International Food of California

225 people in 44 states and the District of Columbia are reported by Federal officials to have been sickened by salmonella as a result of an imported black pepper used in the preparation of salami and other types of Italian sausage made by Daniele International, Inc., a Rhode Island company. The recall involves 1.2 million pounds of ready-to-eat salami Jan. 22, after state health officials and the Centers for Disease Control and Prevention linked the outbreak to the company's products. Daniele expanded the recall Feb. 4 to include 23,754 additional pounds of salami products. An estimated 26% have been hospitalized, officials said. Victims of the outbreak are up to 93 years old, with a median age of 39. More than half, or 53 percent, have been male. This is the second time in less than a year that an outbreak of salmonella illness has been linked to pepper. Last March, 42 people fell ill after eating tainted white and black pepper sold by Union International Food of California. The salami, sopressata and other products were packaged under Daniele as well as the Boar's Head and Black Bear of the Black Woods brands and were sold by several national chains, including Costco and Wal-mart and online through Amazon.com. The outbreak began in July and is ongoing. Because the product has a shelf life of one year, federal health officials are concerned that the products remain tucked away in home freezers and pantries. Last month, officials at the Rhode Island Department of Health said they thought the contamination had been caused by tainted black pepper that was used to coat the salami. Tests showed that the same strain of salmonella involved in the outbreak was present in two open containers of black pepper at Daniele's plant in Burrillville, R.I. State officials said Daniele used two suppliers, Mincing Oversees Spice and Wholesome Spices, which both bought imported black pepper. Samples of pepper from both distributors tested positive for salmonella, according to state health officials. "This outbreak only underscores the importance of closely monitoring food that is imported from other countries as they may not have the same food safety standards as we do," David R. Gifford, the state's director of health, said in a statement. The Department of Agriculture regulates salami, but the Food and Drug Administration oversees black pepper and other food additives. An FDA spokesman said that the agency did not know where the pepper originated and that its joint investigation with USDA continues. Daniele, which has suspended salami production, said in a statement it has changed its spice suppliers and will now use only irradiated pepper, which undergoes a process designed to kill bacteria. Salmonella is a bacteria that can cause serious and sometimes fatal infections in young children, frail or elderly people and others with weakened immune systems. Healthy people infected with salmonella can have fever, diarrhea, nausea, vomiting and abdominal pain. In rare circumstances, salmonella infection can spread to the bloodstream and result in severe illnesses such as arterial infections and arthritis. Health officials say anyone who experiences any of these symptoms after eating an Italian sausage should seek medical help.

Huntington Meat Packing, Inc. Expands Recall of 4.9 Million Additional Pounds of Beef and Veal Due to Adulteration

Huntington Meat Packing Inc. is expanding its recall of January 18 to include approximately 4.9 million additional pounds of beef and veal products that were not produced in accordance with the company's food safety plan. This recall release is being reissued to expand the January 18 recall to include approximately 4.9 million additional pounds of beef and veal products, and to correct net weights from 40 lbs. to 50 lbs. in five instances in the earlier release. The products are adulterated because the company made the products under insanitary conditions failing to take the steps it had determined were necessary to produce safe products, the U.S. Department of Agriculture's Food Safety and Inspection Service (FSIS) announced. FSIS has received no reports of illnesses associated with consumption of these products. Individuals concerned about an illness should contact a physician.

The recall was expanded based on evidence collected in an ongoing criminal investigation being conducted by the Office of the Inspector General (OIG) with assistance from FSIS. This evidence shows that the products subject to this recall expansion were produced in a manner that did not follow the establishment's Hazard Analysis and Critical Control Points (HACCP) plan. A HACCP plan describes the process controls an establishment must take to prevent food safety hazards and create a safe and wholesome product. The investigation has uncovered evidence to show that the food safety records of the establishment cannot be relied upon to document compliance with the requirements. Therefore, FSIS must consider the products to be adulterated and has acted to remove the products from commerce.

The following beef and veal products, produced by the plant from January 22, 2009, to January 4, 2010, are subject to recall:

10 lb. boxes of "IMPERIAL MEAT CO. GROUND BEEF PATTY"
10 lb. boxes of "El Rancho MEAT & PROVISION ALL BEEF PATTIES"
20 lb. boxes of "IMPERIAL MEAT CO. GROUND BEEF PATTY"
50 lb. boxes of "HUNTINGTON MEATS GROUND BEEF"
50 lb. boxes of " HUNTINGTON MEAT PKG. INC. BEEF GROUND FOR FURTHER PROCESSING"
50 lb. boxes of "BEEF BURRITO FILLING MIX"
50 lb. boxes of "HUNTINGTON MEAT PKG. INC. DICED BEEF"
50 lb. boxes of "HUNTINGTON MEAT PKG. INC. SLICED BEEF"
10 lb. boxes of "Huntington Meat VEAL PATTY"
10 lb. boxes of "Imperial Meat VEAL PATTY"
10 lb. boxes of "El Rancho VEAL PATTY"
20 lb. boxes of "Huntington Meat VEAL PATTY"
20 lb. boxes of "Imperial Meat VEAL PATTY"
20 lb. boxes of "El Rancho VEAL PATTY"

Each box bears the establishment number "EST. 17967" inside the USDA mark of inspection on a label. The products were produced between January 22, 2009, and January 4, 2010, and were shipped to distribution centers, restaurants, and hotels within the State of California.

FSIS routinely conducts recall effectiveness checks to verify recalling firms notify their customers (including restaurants) of the recall and that steps are taken to make certain that the product is no longer available to consumers.

FSIS advises all consumers to safely prepare their raw meat products, including fresh and frozen, and only consume ground beef or ground beef patties that have been cooked to a temperature of 160° F. The only way to be sure ground beef is cooked to a high enough temperature to kill harmful bacteria is to use a food thermometer to measure the internal temperature.

The following safety precautions should be taken when preparing or handling beef and veal products including:

1. Wash hands with warm, soapy water for at least 20 seconds before and after handling raw meat and poultry;
2. Wash cutting boards, dishes and utensils with hot, soapy water;
3. Immediately clean spills;
4. Keep raw meat, fish and poultry away from other food that will not be cooked;
5. Consumers should only eat ground beef or ground beef patties that have been cooked to a safe internal temperature of 160° F, whether prepared from fresh or frozen raw meat products;
6. Color is NOT a reliable indicator that ground beef or ground beef patties have been cooked to a temperature high enough to kill harmful bacteria such as E. coli O157:H7;
7. The only way to be sure ground beef is cooked to a high enough temperature to kill harmful bacteria is to use a thermometer to measure the internal temperature;
8 Refrigerate raw meat and poultry within two hours after purchase or one hour if temperatures exceed 90° F.; and
9. Refrigerate cooked meat and poultry within two hours after cooking.

Consumers should immediately discontinue use of the aforementioned products subject to this recall and direct any questions to the company Owner Robert Glenn at 323.726.9714. The toll-free USDA Meat and Poultry Hotline is also available at 888.674.6854 in English and Spanish and can be reached from l0 a.m. to 4 p.m. (Eastern Time) Monday through Friday. Recorded food safety messages are available 24 hours a day.

Helicopter Air Crash Kills 3

Associated Press and Idahostatesman.com report:
PHOENIX — A helicopter crash just north of Phoenix killed at least three people on Sunday afternoon, including a child, and officials couldn't rule out the possibility of more victims.

Residents in the area known as Cave Creek heard noises and saw parts flying off the 6-seat helicopter before it crashed and burst into flames at about 3 p.m. MST.

"I saw the helicopter flying in the air and that stuff that goes round, up, the rotors were coming apart and then I said, 'OK something wrong is gonna happen,'" witness Nicoleta Nork told KTVK-TV. "And I just saw it rolling, rolling and boom, then big smoke and yeah, terrible."

Authorities have specifically identified three victims, said Deputy Lindsey Smith, a spokeswoman for the Maricopa County Sheriff's Office. But since the Eurocopter EC135 can hold six people, officials are looking into whether there were additional victims.

The area is a mix of rolling hills, dry desert washes and lots of houses. The chopper came down in a wash between two homes, Smith said.

"It's a pretty horrific crash," she said. "It's just obliterated."

The debris scattered over hundreds of feet, and deputies were contacting nearby residents to make sure none were hurt and that all the debris was collected for use by investigators. No injuries on the ground were immediately reported.

The helicopter was registered to Services Group of America in Scottsdale, Ariz., a large privately held foodservice and real estate firm. A company spokesman said he didn't immediately have any information about the crash.

Investigators with the Federal Aviation Administration were headed to the crash scene, spokesman Ian Gregor said, and a National Transportation Safety Board investigator was expected to arrive on Monday morning.

There are typically three (3) types of causes for helicopter crashes including, (1) Pilot error; (2) Mechanical malfunction; and/or (3) Electrical malfunction.

I. Operational error.

Most helicopter crashes have been attributable to human/pilot error in the operation of a helicopter. Human error in flight planning, actual pilot control of the vehicle, training and/or improper maintentance. Following any air crash, investigators from the National Transporation Safety Board (NTSB) conduct an investigation regarding the cause of the crash. In looking for operational error, the investigators consider whether there was failure in the operation of the aircraft in accordance with the aircraft’s operational limitations; operation of the the aircraft in unsafe environmental conditions; failure in maintaining a proper flight plan; improper maintenance of the aircraft; improper training of flight and maintenance personnel; faulty manuals, training guides, checklists and operational procedures; and faulty oversight, auditing and review procedures.

II. Mechanical Malfunction.

Sometimes a component of the aircraft fails to function as designed and/or intended. This can happen anywhere along the component’s life due to improper design; inadequate testing; faulty manufacture of the component; inadequate quality control; inadequate operational monitoring; improper installation and/or use; poor maintenance; inadequate lubrication or cooling; and improper installation.

III. Electrical Malfunction

Sometimes a helicopter crashes due to electrical source malfunction or failure, i.e., an electrical source stops working or one of its components has a malfunction. Another Sad Story of Parents Losing a Child Who was Killed Due to Texting While Driving

Another sad story of parents losing a child who was killed because their child was texting while driving (reported by IdahoStatesman.com as follow):
Meridian police officials made a telling discovery on Dec. 29, after emergency crews cut through a tangled mess of what used to be a Ford Mustang to get to the 18-year-old driver trapped inside.

Kassandra Kerfoot's smashed cell phone was right next to her, just under the driver's seat.

Kerfoot had been texting just before losing control of her car and drifting into oncoming rush-hour traffic on Eagle Road. She died later that night.

Her parents are devastated by the loss and don't want anyone else to endure what they have been through.

That's why her mother, Liz Catherman, helped produce a poster - with Kerfoot's picture and the message "Don't text and drive" - that now hangs on the walls of three Meridian high schools, including Meridian High, where Kerfoot graduated in 2009. It's also why Catherman plans to testify in front of the Idaho Legislature later this winter to encourage passage of a bill banning texting while driving.

"This is real. I want (other teens) to know this can happen to anybody," Catherman said.

Catherman said she talked often to her daughter about the dangers of texting and driving, and Kerfoot seemingly would go along with it. Now Catherman hopes the image of a smiling Kassy in the hallways of local high schools will have an impact on students.

"With the poster, the message is simple and direct. It's short, but it says a lot," Catherman said. "Kassy didn't have her seat belt on, either. That could have saved her life. Maybe this can get the message across."

Meridian district officials created about 50 posters for each school - a decision encouraged by several student leaders, district spokesman Eric Exline said.

"It kind of gets your attention, doesn't it?" Exline said. "We were interested in putting out a flier at Meridian High School, but we had a group of student council officers involved who wanted to spread the message more broadly."

BIPARTISAN PUSH TO BAN THE PRACTICE

Sen. Les Bock, D-Boise, failed to get a hearing last year on a bill banning texting while driving, but now Senate Transportation Chairman John McGee, R-Caldwell, has joined the effort.

A Virginia Tech study of truck drivers found that their collision risks were 23 times higher when texting. A University of Utah study of college students found the risk of crashing increased eightfold. And several high-profile accidents around the nation - like Kerfoot's fatal crash on Eagle Road - have focused attention on the issue.

Even Oprah Winfrey has taken it on, asking her viewers to sign "No Phone Zone" pledges against texting while driving.

McGee said he hopes to introduce the bill this week - and he definitely will have Liz Catherman help him push it.

"We knew that texting (while driving) was dangerous, but we didn't know just how dangerous until these studies came out," McGee said Wednesday. "It is time to get something done."

McGee is still tweaking the bill, working on issues like what the proposed fine would be and if the crime would be a traffic infraction or would rise to the level of a misdemeanor.

I'm glad to see that legislation is finally moving forward in Idaho (as in other states) to make it illegal to operate a motor vehicle while texting. Studies mentioned above demonstrate that the operation of a motor vehicle while texting is akin to operating a motor vehicle while under the influence of alcohol.

Toyota Recalls 2010 Camry Due to Possible Brake Failure Causing Increase Risk of a Crash

Toyota announced the recall of its 2010 Camry, because the length of the power steering pressure hose on the vehicle equipped with a 4-cylinder (2AR-FE) engine may be insufficient such that the gap between the crimp on the pressure hose and the brake tube for the left rear brake may be insufficient causing the brake tube to interfere with the crimp resulting in wear and perforation. A brake tube perforation may result in brake fluid leakage increasing the risk of a crash. Toyota has announced that it will replace or adjust the brake tube free of charge. Owners should contact Toyota at 888.327.4236 (TTY 800.424.9153 or go to http://www.safercar.gov.

Generation 2 Worldwide and “ChildESIGNS” Drop Side Crib Brands Recalled; Three Infant Deaths Reported

The U.S. Consumer Product Safety Commission (CPSC) reports the following disturbing recall, namely:
WASHINGTON, D.C. - The U.S. Consumer Product Safety Commission (CPSC) is announcing the recall of all Generation 2 Worldwide and “ChildESIGNS” drop side cribs. CPSC is warning parents and caregivers who own these drop side cribs that infants and toddlers are at risk of serious injury or death due to strangulation and suffocation hazards presented by the cribs. CPSC staff urges parents and caregivers to stop using these cribs immediately and find an alternative, safe sleeping environment for their baby. Do not attempt to fix these cribs.

The crib’s plastic hardware can break which can cause the drop side of the crib to detach from a corner of the crib. When the drop side detaches, it creates a space into which an infant or toddler can roll and become wedged or entrapped. When a child is entrapped between the drop side and the crib mattress, it creates a risk of suffocation or strangulation. In addition, the crib’s mattress support can detach from the crib frame, creating a hazardous space in which an infant or toddler could become entrapped and suffocate or strangle.

CPSC has received reports of three infants who suffocated when they became entrapped between the crib mattress and the drop side when the drop side detached. In July 2007, an eight month old child from Newark, Ohio suffocated when he became entrapped between the drop side and the crib mattress. The drop side of his crib had detached due to a broken plastic stop tab on the lower track. In October 2003, an eight month old child from Richmond, Ind. suffocated when he became entrapped between the drop side and the crib mattress. The plastic hardware on the drop side was broken and allowed the drop side to detach from the crib headboard in one corner. In September 2002, a six month old from Staunton, Va. suffocated when he became entrapped between the drop side and crib mattress. The lower drop side track was missing two screws which allowed it to pull away from the headboard post and detach.

CPSC has also received reports of 20 other drop side incidents, 12 of which involved the drop side detaching in a corner of the crib. In two of these incidents, a child became entrapped. One child suffered bruising from the entrapment. There are five reports of children falling out of the cribs due to drop side detachment. One child suffered a broken arm as a result of the fall.

In addition, CPSC has received 8 reports of mattress support detachment in these cribs. Due to the space created by the detachment, three children became entrapped between the crib frame and the sagging mattress and four children crawled out of the crib. There was one report of cuts and bruises.

Due to the fact that Generation 2 went out of business in 2005, CPSC has limited information about the cribs. Although CPSC does not know the total number of units distributed or the years of production, it is believed that there were more than 500,000 of these cribs sold to consumers. Some of the known model numbers are: 10-110X, 10-210X, 21-110X, 20-710X, 64-315X, 26-110X, 90-257X, 20-810X, 46-715X, 64-311X, 74-315X, 21-815X, 21-810X, 20815X, 308154 and 54915. (The “X” denotes where an additional and varying number may appear at the end of the model number.) However, all Generation 2 Worldwide and “ChildESIGNS” drop side cribs are included in this recall, including those with other model numbers.

The name “Generation 2 Worldwide” appears on a label affixed to the crib’s headboard or footboard. Some labels identify the place of manufacture as Dothan, Ala. Others identify China as the country of manufacture. The name “ChildESIGNS” appears on the teething rail of some of the cribs.

The recalled cribs were sold at numerous local furniture and retail stores including Buy Buy Baby, and Kmart and Walmart stores nationwide for between $60 and $160. Consumers should contact the store from which they purchased the crib for remedy information, which will vary between a refund, replacement crib or store credit, depending on the retailer. Consumers are urged to contact CPSC and report any difficulties in obtaining a remedy from their place of purchase.

Important Message from CPSC:
CPSC would like to remind parents not to use any crib with missing, broken, or loose parts. Make sure to tighten hardware from time to time to keep the crib sturdy. When using a drop-side crib, parents should check to make sure the drop-side or any other moving part operates smoothly. Always check all sides and corners of the crib for disengagement. Any disengagement can create a gap and entrap a child. In addition, do not try to repair any side of the crib, especially with tape, wire or rope.

For more information on Crib Safety, visit CPSC's Crib Information Center.

The CPSC's Crib Information Center is located at http://www.cpsc.gov/info/cribs/index.html. Over 7 million cribs have been recalled since 2007 along with a number of bassinets and play yards. Any consumer can check to see if their crib has been recalled by checking the following website at http://www.cpsc.gov/cgi-bin/cribrecalls.aspx.

Toyota Recalls 2010 Prius and other Hybrid Vehicles Worldwide to Fix Brake Problems

ABC.com News reports:

Toyota says it is recalling about 437,000 Prius and other hybrid vehicles worldwide to fix brake problems — the latest in a string of embarrassing safety lapses at the world's largest automaker.

"I don't see Toyota as an infallible company that never makes mistakes," President Akio Toyoda said at a press conference Tuesday in Tokyo. "We will face up to the facts and correct the problem, putting customers' safety and convenience first."

With the Prius announcement, the number of vehicles recalled globally by Toyota Motor Corp. has ballooned to 8.5 million, including for floor mats which can trap gas pedals and faulty gas pedals that are slow to return to the idle position. The 2010 Prius wasn't part of the earlier recalls.

There have been about 200 complaints in Japan and the U.S. about a delay when the brakes in the Prius were pressed in cold conditions and on some bumpy roads. The delay doesn't indicate a brake failure. The company says the problem can be fixed in 40 minutes with new software that oversees the controls of the antilock brakes.

This recall adds to the list the number of vehicles that Toyota has recently recalled previously for defects in the gas pedal and/or floor mat design or installation. Consumers are directed to immediately contact their local Toyota dealer for an inspection and repair.

Obviously, the proper function of the braking system of a vehicle is an inherent safety issue and should be given a high priority of action by the consumer in order to avoid the risk of injury or death resulting from a possible crash.

The Idaho Central District Health advises:

While the number of people getting flu vaccinations has been unprecedented this flu season, most Idahoans still haven’t gotten the H1N1 flu vaccine. Availability has never been better, with more than 550,000 doses of the vaccine distributed in Idaho. Idahoans who have not been vaccinated now have a window of opportunity to protect themselves and their loved ones against the disease.

The Central District Health Department (CDHD) is making vaccine available to the general public through appointments at all three of its offices in Boise, Mountain Home and McCall. Call the CDHD Flu Hotline 321-2222 (800-962-2343) to make an appointment or for more information. Teams of nurses will continue to vaccinate students in the Boise and Meridian schools through the rest of January and into February. And thousands of doses of vaccine have been distributed to physicians and area pharmacies throughout CDHD’s four county area.

One of the main goals of National Influenza Vaccination Week is to engage those at-risk of serious flu complications, those hesitant about vaccination and those unsure of where to get vaccinated. To that end, who needs the 2009 H1N1 flu vaccine? Simply put, just about everyone. More specifically, these groups:

General Public and Health Care Workers

Now that there are ample supplies of vaccine and it is available to everyone over the age of six months, the general public and health care workers should take the opportunity to reduce their risk of getting the flu and giving it to others.

People with Chronic Health Conditions

People of all ages with chronic health conditions are at higher risk of serious complications of the flu. Such health conditions include asthma, diabetes, heart disease, kidney and liver disorders, neurological disorders, blood disorders, cancer, HIV or AIDS, and others. The flu can make these health problems worse.

People with high risk conditions, ages 25 through 64 years of age have been hit especially hard by 2009 H1N1. A large majority of serious infections and deaths have occurred in this group. It’s important that those who fall within this high risk group, or those with a high risk condition listed above, get vaccinated this year.

Pregnant Women, Children, and Caregivers of Children less than 6 Months Old

A pregnant woman who gets flu has a greater chance for serious problems and even death from influenza. Vaccinating the mother during pregnancy can reduce the risk of influenza for her and for her baby.

Children of all ages are at increased risk of influenza illness, especially children under the age of 2 and children of any age who have chronic health conditions like asthma, neurological conditions, heart disease or diabetes.

Household contacts and caregivers of children 6 months and younger are strongly recommended to receive the 2009 H1N1 vaccine because these children are not old enough to receive the vaccine and could become very sick if they get the flu. The best way to protect these children is to make sure that their caregivers and other adults and children who live with them get vaccinated.

Young Adults

The 2009 H1N1 virus targets many of the same high risk groups as seasonal flu. However, unlike seasonal flu, the 2009 H1N1 virus has also spread quickly among young adults ages 19 to 24 years. Young adults have been hit extremely hard by 2009 H1N1 this year. Since many young adults are regularly around a large variety of people, whether it’s their families, workplace, or classrooms, they are more likely to expose themselves and their loved ones to this virus. Vaccination is not only important for their health, but also for those around them.

Seniors

Older Americans are now recommended to receive the 2009 H1N1 flu vaccine. While older people are thought to be less likely to be infected with the 2009 H1N1 virus compared to younger persons, there have been severe infections and deaths from 2009 H1N1 in every age group, including people 65 and older.

5-year-old Boy Accidentally Shoots Teen with Gun

KTVB.com reports:
Mountain Home Police are investigating how a 5-year-old boy got his hands on a gun, and then accidentally shot a teenager as he was walking by.

The 16-year-old boy who was shot had to be taken by air ambulance to Saint Alphonsus Regional Medical Center in Boise where is listed in serious condition.

The bullet hit him in the back on his left side, and exited through his stomach on the right side.

Police say a 5-year-old boy found a gun inside his home near the intersection of N. 10th and Jackson in Mountain Home and brought it outside to play.

The semi-automatic 9-millimeter gun went off and a bullet struck the teenager -- who was some 75 yards away.

The teen was on his lunch break from Mountain Home High School and was walking to a nearby Maverick convenience store.

When officers arrived, he was lying on the sidewalk.

Police say the 5-year-old was not home alone, his mother was inside cleaning and had no idea her son had taken the gun.

When she heard it go off, she came running outside -- obviously distraught.

"Oh, it's just heart-wrenching. I mean the first thing you think about is: it could have been anybody and also you think about immediately why wasn't the gun secured? I mean, you definitely want the firearm to be secured and definitely not loaded where something like this could happen," Mountain Home Sgt. Rick Viola said.

Police say both of the 5-year old's parents could be charged with child endangerment, which is a felony. That decision will not be made until the investigation is done.

Police are also looking at whether the gun was properly registered.

They say this is a reminder for parents to keep their guns unloaded, locked and out of a child's reach.

They also say if anyone has any questions about gun safety, that local police departments are always willing to help.

Mountain Home Police also offers free gun locks. They want people to take advantage of their help to prevent shootings like this from happening.

Owners of firearms are responsible at all times to secure their weapons away from children. Even locks on weapons have been found on occasion to be insufficient from keeping keep children from being able to fire them.

In order to protect children in a household where a firearm is present, the owner should purchase a gun safe or gun vault such as the one displayed above. Had the owner secured their weapon in a gun vault or safe, this accident would not have occurred. Gun vaults range in price but for a 9mm such as the one used in this case, a gun vault would cost as low as $60.00 to $80.00 (tax not included). See, e.g., http://www.cabelas.com/cabelas/en/templates/pod/standard-pod-wrapped.jsp?_DARGS=/cabelas/en/common/catalog/pod-link.jsp_A&_DAV=null-cat20799&rid=&indexId=cat20799&navAction=push&masterpathid=&navCount=0&parentType=index&parentId=cat20799&id=0039832.

The safest way to protect children is to not keep a firearm at home in the first place. But if you feel that you need to do so, you have an obligation to keep the weapon and its ammunition away from children.

Unfortunately, now the owner of the weapon used in this incident and/or parents of the 5 yr-old may face criminal charges for child endangerment due to their lack of foresight in taking sufficient measures to prevent the 5 yr-old from being able to have access to the firearm. This accident was completely avoidable had the owner of the weapon and/or parent's of the home where the weapon was located had taken measures to store the weapon away from the child's access. Shootings like this happen each year, but can be avoided by taking simple measures.

More Troubles for Toyota: New Complaints Include the 2010 Prius hybrid

CNNMONEY.com reports:
By Peter Valdes-Dapena, senior writerFebruary 3, 2010: 10:22 AM ET

NEW YORK (CNNMoney.com) -- In the wake of massive recalls for gas pedal-related problems, Toyota Motor Co. is now faced with mounting complaints of brake problems in its 2010 Prius hybrid, one of the carmaker's most iconic and popular models.

In the U.S., more than 100 complaints alleging poor brake performance have been lodged with the National Highway Traffic Safety Administration against the 2010 Prius, a newly designed version of the car that was introduced last summer.

2010 Toyota Prius
In Japan, 14 complaints about brakes in the Prius have been lodged since July. Japan's Transportation Ministry has asked Toyota to investigate brake malfunction complaints in Japan on the Prius, according to the Japan Automobile Dealers Association.

"The complaints received via our dealers center around when drivers are on a bumpy road or frozen surface," Paul Nolasco, a Toyota Motor Corp. spokesman in Japan, said. "The driver steps on the brake and they do not get as full of a braking feel as expected."

A search of NHTSA's complaint database turned up many similar-sounding complaints in the U.S..

"I have been driving my 2010 Prius for 6 months and have experienced the following nearly 10 times," wrote one owner, "When braking, if a pothole or bump in the road is hit, the car seemingly jerks forward/accelerates for a split second."

A Toyota spokesman in the U.S. was not immediately able to provide any comment on the situation. A NHTSA spokesman also did not immediately return a call for comment on the issue.

The Prius is Toyota's third best-selling model in the U.S., ranking behind only the Camry midsized sedan and the Corolla compact car.

Toyota's public image, and its sales, have been hit by recent recalls involving unintended acceleration.

Toyota recalled 2.3 million vehicles on Jan. 21 due to problems with sticking gas pedals and later halted the sale of the eight models involved in the recall.

Toyota's U.S. sales plunged 16% in January as a result, even as sales of other automakers rose.

About 4.2 million vehicles were recalled in November for a problem in which the cars' gas pedals could get stuck in some floor mats. The last-generation version of the Prius was included in that recall, which was expanded to include another 1.1 million last week.

Brakes in hybrid cars like the Prius operate differently from brakes in most cars. In addition to standard brakes, which use friction from pads pressed against drums or rotors, hybrid cars use their electric motors to help slow the car, a process that generates electricity to recharge the batteries.

The list of vehicles that Toyota has recalled are discussed in my previous blog at the following website:
http://morton-law.blogspot.com/2010/01/toyota-temporarily-suspends-sales-of.html and are also at Toyota's website at http://www.toyota.com/recall/?srchid=K610_p277905931 which references the floor mat entrapment recall that involves the 2004-2009 Prius.

The news report from CNNMONEY.com references a different issue than the issues noted on the Toyota website. We will continue to monitor and post information regarding this issue as it becomes available. Consumers should be directed to contact their local Toyota dealer to have the vehicle inspected particularly if you find that you are having any issues or complaints noted in this post.
