Abbott Laboratories Recalls Similac Powder Baby Formula Due to Possible Contamination

Abbott Laboratories has announced the voluntary recall of certain Similac® Brand Powder Infant Formulas, because inspections have detected the presence of a small common beetles in the product produced at a facility/plant located Sturgis, Michigan. Consumption of the contaminated product could result in symptoms of gastrointestinal discomfort and refusal to eat as a result of small insect parts irritating the GI tract. If these symptoms persist for more than a few days, a physician should be consulted. The recall of these powder infant formulas includes:

-- Certain Similac powder product lines offered in plastic containers; and
-- Certain Similac powder product lines offered in sizes such as 8-ounce, 12.4-ounce and 12.9-ounce cans.

To immediately find out if the product in your possession is included in this recall, parents and caregivers should visit www.similac.com/recall, and type in the lot number found on the container to determine if the product is affected, or call 800.986.8850.

No liquid infant formulas are impacted by this recall, and products not involved in the recall include all Abbott Nutrition liquid ready-to-feed and concentrated infant formulas and all powder and liquid specialty formulas, such as Similac Expert Care™ Alimentum®, Elecare®, Similac Expert Care™ Neosure®, Similac® Human Milk Fortifier, and metabolic formulas for inherited disorders.

12 Yr. Old Dies from ATV Accident

ELMORE COUNTY -- On Friday, September 10, 2010, Ryder Cole McRae, a 12-year-old boy from Mountain Home, Idaho was killed while driving an ATV. KTVB.com reports that the youngster died from major head injuries after having been thrown from the ATV and landed on the road. He was not wearing a helmet. He was taken to the Elmore County Medical Center and then flown by LifeFlight to the Saint Alphonsus Regional Medical Center in Boise where he died.

Parents should always supervise children when operating an ATV and children should ALWAYS be required to wear a helmet when operating said equipment.

Jo-Ann Fabric and Craft Stores has added its name to the list of retailers who have announced a voluntary recall announced in December 2009 of ALL Roman shades and roll-up blinds due to a risk of stangulation to small children. This recall includes the Bamboo Roll-Up Blinds with Valance. Small children face the risk of strangulation when the lifting loop of the blind slides off the side of the blind and a child’s neck becomes entangled on the free-standing loop, or if a child places his/her neck between the lifting loop and the roll-up blind material. The blinds were sold in two sizes: 36”x72” and 48”x72.” These blinds were sold exclusively at Jo-Ann Fabric and Craft Stores nationwide between April 2009 and December 2009. 380 Million Eggs Recalled Due to Salmonella Contamination

Wright County Egg of Galt, Iowa has increased its voluntary recall of specific Julian dates of shell eggs produced by their farms because they have the potential to be contaminated with Salmonella. Salmonella is an organism which can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems. Healthy persons infected with Salmonella often experience fever, diarrhea, nausea, vomiting and abdominal pain. In rare circumstances, infection with Salmonella can result in the organism getting into the bloodstream and producing more severe illnesses such as arterial infections, endocarditis or arthritis.

Eggs affected by the expanded recall were distributed to food wholesalers, distribution centers and foodservice companies in California, Arizona, Missouri, Minnesota, Texas, Georgia, Washington, Oregon, Colorado, Nevada, Iowa, Illinois, Utah, Nebraska, Arkansas, Wisconsin and Oklahoma. These companies distribute nationwide.

Eggs are packaged under the following brand names: Albertsons, Farm Fresh, James Farms, Glenview, Mountain Dairy, Ralphs, Boomsma, Lund, Kemps and Pacific Coast. Eggs are packed in varying sizes of cartons (6-egg cartons, dozen egg cartons, 18-egg cartons, and loose eggs for institutional use and repackaging) with Julian dates ranging from 136 to 229 and plant numbers 1720 and 1942.

Dates and codes can be found stamped on the end of the egg carton or printed on the case label. The plant number begins with the letter P and then the number. The Julian date follows the plant number, for example: P-1720 223.

Prior Recall

Eggs under the August 13, 2010 recall are packaged under the following brand names: Lucerne, Albertson, Mountain Dairy, Ralph’s, Boomsma’s, Sunshine, Hillandale, Trafficanda, Farm Fresh, Shoreland, Lund, Dutch Farms and Kemps. Eggs are packed in varying sizes of cartons (6-egg cartons, dozen egg cartons, 18-egg cartons, and loose eggs for institutional use and repackaging) with Julian dates ranging from 136 to 225 and plant numbers 1026, 1413 and 1946.
There have been confirmed Salmonella enteritidis illnesses relating to the shell eggs and traceback investigations are ongoing.

Wright County Egg is fully cooperating with FDA’s investigation by undertaking this voluntary recall. Our primary concern is keeping Salmonella out of the food supply and away from consumers. As a precautionary measure, Wright County Egg also has decided to divert its existing inventory of shell eggs from the recalled plants to a breaker, where they will be pasteurized to kill any Salmonella bacteria present.

Consumers who believe they may have purchased these shell eggs should not eat them but should return them to the store where they were purchased for a full refund. This recall is of shell eggs only. Other egg products produced by Wright County Eggs are not affected. Goya Foods Recalls Frozen Mamey Fruit Pulp Linked To Typhoid Fever

Goya Foods issued a recall of its 14-ounce packages of its frozen mamey fruit pulp due to reports of salmonella, the bacteria that causes typhoid fever. The product is distributed in 11 Western states including Hawaii. The Center for Disease Control has confirmed seven cases of typhoid fever in California and Nevada, and said four of the victims drank milkshakes made with the product. The CDC said it will continue to investigate possible typhoid cases, including two more reports out of California.

Mamey -- known as "sapote" in Latin America -- is a red-fleshed fruit native to Mexico and is a common ingredient in milkshakes, smoothies and fruit bars. The product was sold in Alaska, Arizona, California, Colorado, Hawaii, New Mexico, Nevada, Oregon, Texas, Utah and Washington.

Though common in the developing world, typhoid fever has become rare in the United States, with just 400 cases reported annually, according to the CDC. Symptoms of the life-threatening illness include sustained high fever, stomach pain and rash. Typhoid fever can only be diagnosed by testing blood and stool samples, and is treated with antibiotics.

Kariño Baby Pacifiers distributed by Antonio Flores of San Ysirdo, CA have been recalled, because the nipple can easily separate from the base posing a choking hazard. The pacifer fails to comply with federal safety standards for the design and manufacture of this product in that the pacifer handle is too long and the mouth gaurd is too small and there are no ventilation holes on the mouth guard. The product causes both a choking and aspiration hazard to young children using the product. The pacifer has a ring shaped handle and a round shaped mouth guard. "Kariño" is printed on the handle side of the mouth guard, and "Mygra" is printed on one side of the handle. The nipple is filled with corn syrup. Portable Playard Tent by Tots in Mind Recalled Due to Strangulation Hazard

Portable Indoor Outdoor Playard Tents Plus Cabana Kits by Tots in Mind, Inc. have been recalled, because the clips that attach the tent to the top of the playard can break or be removed by a child allowing a child to lift the tent and become entrapped at the neck between the rigid playard frame and the metal base rod of the tent. This poses a risk of strangulation to the child occupant. At least one 2-year-old boy in December 2008 in Vinalhaven, Maine has died as a result of the use of this product. The boy was found hanging with his neck entrapped between the playard frame and the metal base rod of the tent that had been partially tied by pieces of nylon rope and partially attached by clips. The tent was tied to the playard because the child was able to pop off the clips. Apparently, the child became entrapped while attempting to climb out of the playard. In three other incidents, children were able to remove one or more clips and place their necks between the tent and the playard. The children were not injured.

The dome-shaped white-colored mesh tent is designed to fit over playards as small as 28 inches by 40 inches or as large as 31 inches by 44 inches to contain a child. There are 12 plastic clips to secure the base of the tent to the top rail of the playard through button holes along the bottom of the tent. The tent has a zippered side for putting in and taking out the child. The cribs were made in China and sold at Walmart, Amazon.com and various baby and children’s stores nationwide from January 2005 through February 2010 for about $60. Diabetes Drug Maker Hid Test Data

The NY Times reports,

In the fall of 1999, the drug giant SmithKline Beecham secretly began a study to find out if its diabetes medicine, Avandia, was safer for the heart than a competing pill, Actos, made by Takeda.

Avandia’s success was crucial to SmithKline, whose labs were otherwise all but barren of new products. But the study’s results, completed that same year, were disastrous. Not only was Avandia no better than Actos, but the study also provided clear signs that it was riskier to the heart.

But instead of publishing the results, the company spent the next 11 years trying to cover them up, according to documents recently obtained by The New York Times. The company did not post the results on its Web site or submit them to federal drug regulators, as is required in most cases by law.

“This was done for the U.S. business, way under the radar,” Dr. Martin I. Freed, a SmithKline executive, wrote in an e-mail message dated March 29, 2001, about the study results that was obtained by The Times. “Per Sr. Mgmt request, these data should not see the light of day to anyone outside of GSK,” the corporate successor to SmithKline.

The heart risks from Avandia first became public in May 2007, with a study from a cardiologist at the Cleveland Clinic who used data the company was forced by a lawsuit to post on its own Web site. In the ensuing months, GlaxoSmithKline officials conceded that they had known of the drug’s potential heart attack risks since at least 2005.

But the latest documents demonstrate that the company had data hinting at Avandia’s extensive heart problems almost as soon as the drug was introduced in 1999, and sought intensively to keep those risks from becoming public. In one document, the company sought to quantify the lost sales that would result if Avandia’s cardiovascular safety risk “intensifies.” The cost: $600 million from 2002 to 2004 alone, the document stated.

Mary Anne Rhyne, a GlaxoSmithKline spokeswoman, said that the company had not provided the results of its study because they “did not contribute any significant new information.”

The company said that Avandia was safe and that Dr. Freed no longer worked for GlaxoSmithKline.

A panel of experts will meet Tuesday and Wednesday to decide whether Avandia should still be sold and whether it is ethical to test Avandia directly against Actos.

Whether to withdraw Avandia is a question that has split the F.D.A., with some officials arguing that the drug is useful despite its risks and others insisting that it must be withdrawn.

According to the documents, Dr. John Jenkins, director of the agency’s office of new drugs, who has argued internally that Avandia should remain on the market, briefed the company extensively on the agency’s internal debate.

“It is clear the office of new drugs is trying to find minimal language that will satisfy the office of drug safety,” a top company official wrote in an e-mail message after he spoke with Dr. Jenkins, according to a sealed deposition obtained by The Times.

In the deposition, Dr. Rosemary Johann-Liang, a former supervisor in the drug safety office who left the F.D.A. after she was disciplined for recommending that Avandia’s heart warnings be strengthened, said of Dr. Jenkins’ conversations with GlaxoSmithKline, “This should not happen, and the fact that these kind of things happen, I mean, I think people have to make a determination about the leadership at the F.D.A.”

An F.D.A. spokeswoman said the agency would not comment on the contents of the deposition.

Members of Congress, where the Avandia case has led to legislative changes, said they were outraged at GlaxoSmithKline’s behavior.

“When drug companies withhold data regarding safety concerns about their medicines, they put patients at risk,” said Senator Max Baucus, Democrat of Montana, who is chairman of the Senate Finance Committee. Mr. Baucus and Senator Charles E. Grassley of Iowa, the committee’s ranking Republican, spent years investigating GlaxoSmithKline’s development of Avandia.

Besides the trial comparing Avandia with Actos, the company also conducted trials comparing Avandia with glyburide, a cheaper and older diabetes medicine.

When Rhona A. Berry, a company official, asked about publishing two of the trials, Dr. Freed responded in an e-mail message dated July 20, 2001, that referred to Avandia by the abbreviation of its generic name, rosiglitazone: “Rhona — Not a chance. These put Avandia in quite a negative light when folks look at the response of the RSG monotherapy arm,” the message said. “It is a difficult story to tell and we would hope that these do not see the light of day.”

Hiding the results of negative clinical trials was once widespread in the drug industry.

But after GlaxoSmithKline was found in 2004 to have hidden data that showed that its antidepressant, Paxil, led children and teenagers to have more suicidal thoughts and behaviors, the company settled a lawsuit by agreeing to publicly post data from all of its trials. In 2007, Congress mandated such disclosures. But the postings are often little more than cryptic references, so the issue is far from resolved.

With Avandia, GlaxoSmithKline has done more than hide trial data. An F.D.A. reviewer who closely examined a landmark Avandia clinical trial called “Record,” found at least a dozen instances in which patients taking Avandia suffered serious heart problems that were not counted in the trial’s tally of adverse events, mistakes that further obscured Avandia’s heart risks.

The company’s conduct of the Record trial has received sharp criticism from medical leaders for other reasons as well. To compare Avandia and Actos in 1999, researchers at SmithKline measured Actos’s effects in patients in the same way that they had conducted earlier trials of Avandia so that the results for the two drugs could be compared.

When the results of the study suggested that Avandia was more dangerous than Actos, the company decided against further comparisons.

It's the 4th of July weekend! A time for celebration and fun with the family. Children are drawn to fireworks like a moth to a light. Hence, it's time to remind ourselves and our children and grandchildren the need to consider safety first regarding the use of fireworks. Each year emergency rooms see victims injured due to the misuse of fireworks. The National Safety Council on Fireworks Safety has published the following video regarding the safe use of fireworks.

- Never allow children to use fireworks without adult supervision;
- Make sure that if children are near and around fireworks that fireworks are used consistent with the manufacturer's recommendations;
- When fireworks are used, place them on a flat surface away from children in the case of a misfire;
- Have a bucket of water or two to use - a place to put used sparklers in so children don't burn themselves by stepping on a burned out sparkler;
- Have a garden hose ready for use "just in case" grass or other items are inadvertently set on fire from the use of fireworks;
- Don't allow children around a "firework" while lighting or deploying a firework;
- Don't attempt to relight a dud;
- Afterwards, make sure you soak a used firework before attempting to put the same out with the garbage to prevent a fire from developing; and
- The best and safest form of enjoying fireworks is to see them deployed by professionals!

Ethyl alcohol is toxic and can cause serious injury or death if ingested by children. This recall involves some bottles of Scope® Original Mint Mouthwash in 1 liter sizes. The recalled bottles have the number 4 on the bottom of the bottle. The bottles with the 4 on the bottom may not be child-resistant. Consumers can also attempt to twist the cap open. GE Appliances & Lighting have recalled its GE Front-Load Washing Machines, because a wire can break in the machine making contact with a metal part on the washtub while the machine is operating posing fire and shock hazards to consumers. The bread is offered in bags that have a red band as well as square lock tabs in the following colors and dates: white tab -- 6/14 or 6/21; blue tab -- 6/15; tan tab -- 6/17; green tab -- 6/18; and red tab -- 6/20. The product was sold in California, Idaho, Washington and Oregon.
The manufacturer has advised that consumers may return the bread to the store for a full refund.

Crash on I-84 May Have Been Alcohol Related

KTVB.com reports another motor vehicle collision occurred early yesterday morning that may have been alcohol related.

NAMPA – Two people were injured after an early morning crash on Interstate 84 Sunday.

The three-vehicle crash happened around 3:10 a.m. at milepost 38 near Nampa.

Jeffrey Hopf, 37, of Caldwell, was traveling westbound in a Ford F-150 pick-up when he struck a Volkswagen Golf driven by Jenna Spencer, 25, of Sagle, ID.

The impact caused Spencer's vehicle to crash into a Dodge pick-up driven by Steven Martinez, 31, of Nampa.

Hopf and Spencer were both transported to St. Alphonsus Medical Center with non-life threatening injuries.

Alcohol is a factor in this crash. It appears all drivers of the vehicles were wearing their seatbelts.

The crash is still under by Idaho State Police.

In Idaho, the purveyor of alcohol to an obviously intoxicated person may also be liable for injuries caused by a motor vehicle collision caused by the drunk driver. However, the purveyor must be given notice of the claim within 180 days of the onset of injury or death. If you or a loved one is injured due to the negligence of a drunk driver, it is wise to consult with an attorney who may be able to preserve and protect your legal rights and remedies by investigating the claim and serving a notice of dram shop prior to the expiration of the aforesaid 180 day period.

Dodge Calibers and Jeep Compasses Recalled Due to Sticky Gas Pedals

The Associated Press reports that Chrysler, the manufacturer of the Dodge Caliber, is recalling 35,000 of the vehicles, to repair and replace a potential problem of sticky gas pedals that has plagued millions of Toyotas. The recall affects 25,000 Calibers in the U.S. from 2007 and a limited number of 2007 Jeep Compass sport-utility vehicles to inspect the ones manufactured from March to May 2006. The remaining vehicles are located in Mexico, Canada and elsewhere. Consumers should contact their local Chrysler dealers to schedule an appointment to have their vehicles inspected and/or repaired.

Maytag Announces Recall of 1.7 Million Dishwashers Due to Fire Hazard

The Maytag Corp. has announced the recall of 1.7 million dishwashers due to a serious fire hazard created by an electrical failure in the heating element. The manufacturer has received 12 reports of fires due to the aforesaid defect. The recall includes Maytag®, Amana®, Jenn-Air®, Admiral®, Magic Chef®, Performa by Maytag® and Crosley® brand dishwashers with plastic tubs and certain serial numbers. The affected dishwashers were manufactured with black, bisque, white, silver and stainless steel front panels. The brand name is printed on the front of the dishwasher. The model and serial numbers are printed on a label located inside the plastic tub on a tag near the left side of the door opening. Serial numbers will start or end with one of the following sequences.

It's Memorial Day Weekend - Be Careful Traveling

The National Highway Transportation Safety Administration (NHTSA) reports that 33,963 people died last year (2009) in motor vehicle collisions. The Memorial Day weekend is a holiday period targeted by the Operation Combined Accident Reduction Effort (CARE) program sponsored by the International Association of Chiefs of Police in an effort to reduce traffic deaths through high visible enforcement and education. The National Safety Council estimates that over 24,700 people may suffer nonfatal disabling injuries and over 470 people may die from traffic accidents during the Memorial Day weekend. Memorial Day weekend begins today at 6:00 p.m., Friday, May 28, 2010 and continues to 11:59 p.m., Monday May 31, 2010.

Here's a few tips to consider:

- Where your seat belt while occupying a motor vehicle;
- Drive while sober; don't drink and drive;
- Focus on the road and minimize distractions such as using a cell phone while driving and/or texting;
- Drive defensively;
- Reduce speed; make sure you make your travel plans with plenty of time to get to your destination without having to speed. The faster the speed, the less reaction time you have for any hazard ahead of you; and
- Be courteous while driving. Act/don't react. Don't let your emotions take over while driving if someone "cuts you off" or otherwise acts inappropriate on public roads or highways.

Drivers who use their cell phones or text while driving (sending or receiving) significantly increase the risk of being involved in a motor vehicle collision.

Local Bicyclist Struck by Motorist on Cole Road

Idahostatesman.com reports that a female bicylist was riding a bicycle today (5/25/10) along Cole Road near Ustick Road when a car turning onto Cole Road from a parking lot crashed into her. Fortunately, the bicyclist was reported to to be uninjured but was transported to a local hospital to get checked out. The motorist was cited for failing to stop before entering the roadway. Cyclists on the roadway in bike lanes must follow the direction of traffic, however, bicycles on sidewalks don't have to follow that rule. During the summer months more bicycles will be on sidewalks and public streets, so both bicylists and motorists need to be alert for each other and bicyclists should have eye contact with motorists before riding in front of any motor vehicle.

US Senate Considering Legislation to Ban the Sale of Drop-Side Cribs Due to Risk of Suffocation or Strangulation

Over 7 million drop-side cribs have been recalled in the United States due to the risk of suffocation or strangulation to infants. However, notwithstanding the recalls and the stores such as Babies R Us and Walmart removing them from sale floors, said cribs are still available for after market sales vis a vis the internet leading the U.S. Senate to consider legislation to prevent the sale and resale of the dangerous products in the United States. Over 32 deaths have been attributable to the use of drop-side cribs and an additional 14 deaths are suspect as well.

Raw alfalfa sprouts distributed by Caldwell Fresh Foods of Maywood, CA have been recalled due to salmonella contamination that has reportedly sickened over 20 people in 10 states.

The recalled alfalfa sprouts are labeled and packaged as follows:

1) Caldwell Fresh Foods - 4-ounce plastic cups and one pound plastic bags, and 2-pound and 5 pound plastic bags in cardboard boxes with sticker affixed with the printed words Caldwell Fresh Foods;

2) Nature's Choice - 4-ounce plastic cups; and

3) California Exotics brands - 5-ounce plastic clamshell containers.

The alfalfa sprouts were distributed to a variety of restaurants, delicatessens and retailers nationwide. Another Lettuce Recall Due to E-Coli Contamination

Freshway Foods has announced a voluntary recall of its Romaine lettuce produce due to possible E-coli 0145 contamination. The recalled products were sold to wholesalers, food service outlets and some in-store salad bars and delis located in Alabama, Connecticut, District of Columbia, Florida, Georgia, Illinois, Indiana, Kansas, Kentucky, Maryland, Massachusetts, Michigan, Missouri, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, South Carolina, Tennessee, Virginia, West Virginia, and Wisconsin.

The symptoms associated with E. coli may range from none to mild diarrhea to severe complications. The acute symptoms include severe abdominal cramps and diarrhea, which may be bloody. Patients may progress to serious complications, such as kidney damage. FDA and CDC encourage anyone with the symptoms listed to contact his or her health care provider immediately.

The recalled shredded romaine lettuce has a “best if used by” date of May 12 or earlier. The Freshway Foods press release advises restaurants, distributors, and retailers to throw out or refrain from using shredded romaine lettuce from Freshway Foods with these “use by” dates. Additionally, Freshway Foods is advising consumers not to eat “grab and go” salads sold in-store salad bars and delis at Kroger, Giant Eagle, Ingles Markets, and Marsh stores.

Shredded romaine lettuce from Freshway Foods with “use by” dates after May 12 are not involved in this voluntary recall. Romaine lettuce and other types of lettuce and leafy greens from other producers are also not affected by this recall.

Multiple lines of evidence have implicated shredded romaine lettuce from one processing facility as a source of infections in a multistate outbreak to which this recall may be related.

To date, 19 confirmed cases of E. coli O145 illnesses have been reported from Michigan, Ohio, and New York. These illnesses include 12 individuals who have been hospitalized, and three with a potentially life threatening complication called hemolytic uremic syndrome (HUS). HUS is a serious condition in which the body’s blood-clotting mechanisms are altered, causing blocked circulation or bleeding in the brain or kidneys.

The evidence includes preliminary results of product trace back investigations that indicate that the shredded romaine lettuce consumed by ill persons in three states originated from one processing facility. Preliminary results of a case-control study in one state that found a statistically significant association between E. coli O145 infection and ingestion of lettuce from the same processing facility; and recovery of E. coli O145 from an unopened package of shredded romaine lettuce from the same processing facility that was obtained from a food service entity associated with the outbreak.

Two Vehicle Car Crash Results in Seven People Going to the Hospital

A two vehicle motor vehicle collision occurred at the intersection of Willis Road and Emmett Road near Middleton, Idaho at approximately 3:45 p.m., on Saturday, April 24, 2010, which resulted in seven (7) people going to the hospital. A 2003 Chevrolet Trail Blazer was reportedly driven by Lyudmila Yanchuk, 40, of Meridian, which was traveling eastbound on Willis Road. Yanchuk was reportedly not familiar with the area and failed to yield at a stop sign at the intersection of Willis Road and Emmett Road. Yanchuck's vehicle was struck by a 1991 Isuzu Box Van, traveling northbound on Emmett Road driven by Terry Asher, 37, of Emmett. The box van rolled, coming to rest on its top, and the Trail Blazer collided with a power pole. Alcohol is not a factor in this crash. The crash is still under investigation Idaho State Police.

When approaching a stop sign, the driver has the duty to come to a complete stop and then yield-the-right of way to traffic traveling in the cross direction. We do not know at this juncture what caused the driver of the vehicle to disobey the stop sign or whether the driver was distracted, but clearly the vehicle failed to stop at the intersection controlled by a stop sign resulting in seven individuals sustaining injury requiring them to go to the hospital to be evaluated further.

18 Month Year Old Drowns In Payette River Near Horseshoe Bend

Every year it's the same old tune with different lyrics ... another child drowns due in part to lack of adult supervision. This time the body of an 18-month-old girl was reported to have wandered away from a home in Horseshoe Bend and was found hours later under water at a diversion dam approximately 4 miles away according to a Boise County Sheriff's Deputy.

The toddler's home is located next to the Payette River according to the toddler's parents. Parents of the toddler reported the child missing moments after the child apparantly wandered out an open door in the home and made her way to the river. There is no fense between the home and the river. Search teams were immediately dispatched from Boise County, Horseshoe Bend, Garden Valley, Idaho State Police and Idaho Fish and Game. Residents and a helicopter crew from the Idaho Air National Guard also helped in the search. The Boise County Sheriff's Office reports that a Fish and Game officer observed the girl's body floating in a diversion canal off of the Payette River which allowed searchers to retrieve the toddler's body at a diversion dam in the canal. The Payette River is flowing high and fast due to recent rain and snowmelt making it extremely dangerous. The Payette River was flowing at 5870 cubic feet per second near Horsehoe Bend on Wednesday, April 20, 2010 which is approximately 3 times as much water as April 15, when it was under 2,000 cubic feet per second according to U.S. Geological Service reports. The Boise County Sheriff's Office reports that the Payette River is no more than 40 degrees and it is nearing overflow level.

Parents and Grandparents should take special precaution to insure that children and grandchildren are supervised at all times when they are near water in order to protect them from the hazards associated with drowning. Albeit this child lived near a river, it's a good reminder to all that children should never be allowed to play near a canal and when near a river, they should be supervised at all times.

Man Killed in Head-On Collision at Maple Grove Overpass

Boise Police Officers are conducting a collision reconstruction of a motor vehicle crash that occurred during rush hour traffic the morning of Wednesday, 4/21/10, at the south side of the overpass at I-84 and Maple Grove Road. A male driver is reported to have been operating a Cadillac Seville served across three lanes of traffic and allegedly caused a head-on collision with an older model flatbed pickup truck. The driver of the pickup truck was killed as a result of the crash.

Boise Police crash reconstruction experts and detectives are trying to determine why the male driver of a Cadillac Seville swerved across three lanes of traffic and slammed head-on into an older model flatbed pickup truck.

The male driver of the truck was pronounced dead at the scene. The driver of the Cadillac was ambulated to St. Alphonsus Regional Medical Center with serious injuries. Witnesses said the pickup was in the far right southbound lane, while the Cadillac was headed north in the far right lane, when suddenly the Cadillac served to the left and hit the pickup head-on. The airbag in the Cadillac deployed.

Investigators did not find any seat belts in the older model truck. It had a bench seat that appears to have flown forward upon impact. Officers found the truck driver severely injured when they arrived. He was put in an ambulance but died at the scene.

A reminder to us all to remember to wear our safety belts at all times while in a motor vehicle. Unfortunately, the older model pickup did not have a functioning set of seat belts installed in the vehicle. It is estimated that if 90% of Americans wore their seat belts, that would prevent more than 5,500 deaths and 132,000 injuries annually.

Teens Seriously Injured Due to Motor Vehicle Crash

A Honda Civic collided with a gravel truck on Tuesday, April 20, 2010, at the Meridian intersection of Linder and Ustick Roads after the Honda allegedly ran a red light sending both occupants (teenagers) to the St. Alphonsus Regional Medical Center with serious injuries. The driver of the truck was reported not to sustain any injuries. The investigation is continuing.

Teenage drivers make up only 10% of the U.S. population, however, each year approximately 5,000 teenagers between the age of 16 and 20 die each year in motor vehicle collisions. About 400,000 teenagers of similiar age will be seriously injuried.

Lexus Instructs Dealers to Stop Sale of Its GX460 SUV Due to Safety Concerns

On the wake of Consumer Reports issuing a "don't buy" recommendation for the 2010 Lexus GX460 SUV, Toyota Motor Company has instructed its dealers to discontinue the sale of the vehicle because of reports of a dangerous handling problem which causes the vehicle to swerve resulting in a heighten risk of roll-over exposing the occupants to a risk of serious injury or death. Consumer Reports noted, “When pushed to its limits on our track’s handling course,” the magazine wrote on its Web site, “the rear of the GX we bought slid out until the vehicle was almost sideways before the electronic stability control system was able to regain control.”

Toyota Announces Recall of 600,000 Sienna Minivans

Toyota is reported to have issue a recall of 600,000 Sienna minivans due to rusting spare tire holders. Toyota said its latest recall covered the 1998-2010 model year Siennas with two-wheel-drive that have been sold or registered in 20 cold-climate states and the District of Columbia. Toyota said rust from road salt could cause the carrier cable that holds the spare tire to rust and break allowing the tire to tumble into the road. The problem could threaten the safety of other drivers.

Police Officer Served With Adulterated Hamburger

Burger King has reportedly fired two employees at a store/outlet in Washington for being allegedly involving in serving a police officer with food products after they had spit into the food.

It's probably a good idea for consumers especially police officers to inspect their food to make sure that the food is properly cooked and nothing looks out of the ordinary to insure that the food has not been adulterated. If the food appears to be adulterated, tell the manager and notify the police. If you surrender the adulterated food to the store, you likely destroy the very evidence you have to have a claim prosecuted criminally and/or civilly. Check your Easter Baskets for Dangerous Toy

BOISE -- One Boise family's early Easter turned into quite the ordeal Saturday afternoon after finding a potentially life-threatening toy in their child's Easter basket. Their concern has prompted a nationwide recall at one retailer and now the family is warning other parents to be on the lookout.

The Szpak family celebrated Easter a day early with family. They purchased a toy for their child, which was a stamp of Lightning McQueen from the popular Disney movie 'Cars' from their local Fred Meyer store.

“At first he took it out and started playing with it and got it all over,” said Colleen Szpak.

They didn't think much of the mess the ink from the stamp had made until a few hours later when they found a warning label buried underneath shreds of paper.

The warning read as follows : “Warning, possible cancer agent. When using do not eat, drink or smoke. Wash hands immediately after use."

The Szpak's, who regularly check Web sites regarding toy safety, were alarmed and jumped into action.

“We put him in the bathtub immediately," Szpak said. "We were very scared for him and for all the other little kids that may be getting stamps for Easter. No product should have cancer-causing agents, especially for a child.”

The family called the Fred Meyer store on Federal Way where they bought the toy. A store manager was alarmed by the label and decided to pull the toy from store shelves, but the family worries it may be too late.

“There were only about eight left on the shelves, so that's disturbing also, because how many children are opening these today and tomorrow,” said Szpak.

Their warning to parents -- check your child's Easter basket.

“Avoid having to explain why the Easter bunny brought something that we're throwing away,” said Szpak.

The local Fred Meyer contacted corporate offices who decided to pull the toy from their store shelves nationwide. Fred Meyer pulled the Disney "Easter Stamper" featuring Lightning McQueen from 'Cars'. There's also a Disney "Easter Stamper" with 'Cinderella'.

If you have one of these toys, Fred Meyer said to either throw it away, or bring it back to the store for a full refund.

Parents, I encourage you to check your children's Easter baskets to insure that this toy is removed before exposing your child or children to ingredients that may be carcinogenic. I'm troubled that a warning label accompanies this toy. Such ingredients should be recalled and children should not be exposed to this danger.

Head On Collision in Nampa May be Alcohol Related

Idaho State Police and Nampa Police investigating a head on motor vehicle collision that occurred at the intersection of Middleton and Orchard Roads the evening of March 26, 2010 contend that the collision may be alcohol related. Nampa Police report that they received a number of calls around 9:30 p.m. last Friday indicating that a 2007 Chevy Colbalt traveling northbound on Middleton Road had be striking mailboxes and other items before traversing across the center line and colliding with a 1999 Ford Explorer head on.

In Idaho, the operation of a motor vehicle with a blood alcohol content of .08 or more is illegal and constitutes a misdemeanor the punishment of one who is over the age of 21 years of age for a first offense carries with it a jail sentence of up to 6months in the county jail, a fine of up to $1,000.00 and the suspension of the driver's license for 30 days.

Of course, any driver who proximately causes bodily injury or property damage as a result of operating a motor vehicle in a negligent manner may also be liable to pay for said damages. In the case where the operator was served alcohol while in an obviously intoxicated state, the purveyor of the alcohol to the obviously intoxicated driver could also be liable for said damages, but the time period for serving a notice of claim under the "dram shop" statute (Idaho Code Section 23-808) is 180 days from the date of injury. Failure to serve the notice of dram shop claim within 180 days from the date of injury could be prejudicial to your legal rights and remedies. House Bill Making it Illegal to Text and Drive Advances to the Senate

Texting while operating a motor vehicle is dangerous. The Idaho House of Representatives recently passed a watered down bill making texting while operating a motor vehicle an infraction in Idaho punishable by a fine of $50.00. The bill advances to the Idaho Senate for approval. If approved, the bill will go to the governor for his consideration and signature or veto. Earlier the Idaho Senate passed a bill that would make texting while driving a misdemeanor punishable by 90 days jail and a $300.00 fine or both.

Aged Tires Are a Hidden Danger to Your Family and You

Check your tires for aging.

In May, 2006, Willie Moreno, age 11 years old, was killed when his family's Ford Explorer rolled over on a highway in Riverside, California. The cause of the crash was attributed to a catastrophic tread separation of the left rear tire that had been discovered to have been found that had been manufactured 12 years prior to the accident. American Tire Depot (ATD) was found to be negligent for installing the tire involved in the accident. The claim against ATD was that ATD was responsible for rotating the 12 year-old spare tire onto the Ford Explorer when the vehicle was brought in for replacement tires. It is reported that the family went to ATD to replace its two rear tires, and that ATD sold them one tire and told them to rotate the spare tire in.

Aged tires present a hidden danger even if the tire treads are unworn and haven't been driven a mile according to consumer and tire industry sources. As the tires age they can deteriorate and become brittle. Hence both automobile and tire companies have issued bulletins recommending the shelf life of a tire between six and ten years. In Moreno's case, Bridgestone Firestone sent out a technical bulletin to its dealers advising, "It is recommended that all tires (including spare tires) that were manufactured more than ten (10) years previous be replaced with new tires." Also in 2005, Ford Motor Company issued an advisory about aged tires, stating, "Tires degrade over time even when they are not being used." Hence, Ford recommends replacing tires "after 6 years of normal service."

Last year, the California legislature enacted legislation requiring dealers to disclose the age of a tire in writing to consumers prior to the sale or installation of a tire. Not a bad idea for Idaho to consider this perhaps in the next legislative session.

How can you check your tires to determine their age?

Each tire has a stamping that provides a DOT marking thereon. As an example in the picture noted above, the tire has a stamp thereon that reads, "DOT MK87 FOWR 4202." That stamping provides the following information, namely The "DOT" stamp notes that the tire met the U.S. Department of Transportation safety standards as of the date the tire was manufactured. The "MK" stamp notes the tire plant code where the tire was manufactured. The "87" stamp indicates the tire size code. The "FOWR" stamp indicates the manufacturer's symbol identifying the tire brand. Lastly, the "4202" stamp indicates the week and year the tire was made - in this case, the tire was manufactured in the 42nd week of the year 2002.

Check your tires to see how old they are, and a tire happens to be six (6) years or older, consider having them replaced. Traveling at speed on a tire 6 years or older could result in a catastrophic tire separation causing a loss of control of the vehicle and a crash. In this sad story, an 11 yr. old lost his life. Don't let that happen to your family or you. Take action now.

Unfortunately, in Idaho, we have no law that requires a company that sells or installs tires to notify the consumer of the age of the tire at the time of sale or installation (or rotation). I will be working to get this law changed, however, in the interim, check your tires now to insure that your tires aren't over the recommended age limit in order to protect your family from severe injury or death.

Mother Charged with Injury to a Child due to Allowing Minor with Access to Firearm

MOUNTAIN HOME -- Prosecutors in Elmore County have charged the mother of a 5-year-old boy who accidentally shot another child.

Police say the boy found a gun inside his home in Mountain Home and brought it outside to play.

The semi-automatic 9 millimeter gun went off and a bullet struck the teenager in the back who was some 75 yards away.

The 16-year-old survived but has a long road of recovery.

Now Molly McFadden, the mother of the 5-year-old, who was home at the time of the shooting, is charged with Injury to a child.

The other adult living in the home is in the Air Force. Nathaniel Harman has been referred to the U.S. Air Force for review.

Unfortunately, this incident could have been easily avoided by the purchase and use of a gun vault or safe which are easily obtained and economical for as low at $75.00. Idaho Code Section 18-5001 makes the offense of an injury to a child (a felony) punishable in a county jail up to no more than one (1) year OR in a state prison no less than one (1) and no more than ten (10) years.

This is a hazard easily avoided by the purchase and use of a gun vault which makes the weapon unavailable to minors to play with which can result in the child or others being exposed to injury or death as a result thereof. "A stitch in time saves nine."

Graco Harmony High Chairs by Graco Children's Products Inc. have been recalled, because the the screws holding the front legs of the high chair can loosen and fall out and/or the plastic bracket on the rear legs can crack causing the high chair to become unstable and causing the high chair to suddenenly tip over unexpectedly. This can create a risk that a child sitting in the high chair to fall from the chair exposing the child to personal injury and/or death. The manufacturer reports 464 incidents where the screws have loosened and/or fallen out of the high chair and/or the plastic brackets have cracked causing the chair to tip over unexpectedly. These incidents include 24 reports of injuries to children of various severity. Tumi, the manufacturer of Mobile Power Packs, has issued a recall of the product, because the lithium-ion cells used in the product can ignite or explode during charging posing a fire hazard. The hazard, however, is reported present only in units that have not been charged. The recalled Mobile Power Pack is a mobile device that receives an AC charge in a compact battery pack that will then give five DC charges to small electronic devices including mobile phones, MP-3 players, Blackberries, and PDAs. The power pack is black and silver and is rectangular in shape. The front of it has a small circular control panel. The front also displays the word “Tumi” engraved on a silver button located towards the bottom of the device. Style number 14362 is printed on the power pack packaging. Idaho Hospital Lobbies for Exemption for Allegedly Granting Hospital Privileges to Physician With Drinking Problem

A local Idaho hospital is lobbying to enact legislation which would exculpate, exonerate and/or excuse hospitals from liability for allegedly granting hospital privileges to a physician with a known drinking problem. Physicians working in a hospital setting that are currently dealing with alcohol addiction are a risk to the public health and safety. Knowingly granting the privileges of one who arrives at the hospital under the influence is a severe hazard to the public health.

Just as physicians are liable and accountable for the decisions they make that negligently harm others, so should hospitals. Allowing a physician hospital privileges while the physician has a known history of drunkenness and allowing same to render treatment in the hospital while under the influence of alcohol is a severe risk to public health.

In Idaho, we teach our children and grandchildren to be responsible and accountable for the things that they say and do. Senate Bill 1373 is inconsistent with Idaho values.

Change to Daylight Savings Time - Time to Change Batteries in Smoke Alarms and Filters

Now that we have reached Daylight Savings Time, don't forget it's time to change the batteries in your smoke detectors and alarms. Also, it's a good time to inspect and change the filters in your furnace. The life you save may be your own.

Here are a few safety tips to consider:

1. You should test your smoke detector once a month.
2. Purchase a few extra batteries when you purchase your detector so that you always have some on hand. It's easy to put this important, life-saving task on hold.
3. Replace all smoke detectors after 10 years.
4. You may want to consider purchasing a combination smoke/carbon monoxide detector, which costs more money but is well worth it.
5. If a smoke detector goes off in your home, you literally have seconds to respond. There is absolutely no time to gather possessions, pets and possibly even one another. Your best response is to leave the home immediately, gather at your prearranged meeting place and call 911 from a neighbor's home.
6. Avoid getting any paint or dust on your smoke detector.
7. Make sure that the smoke detector you choose has been tested by an independent testing laboratory.

U.S. Consumer Protection Commission Issues Warning About Sling Carriers for Babies

The U.S. Consumer Product Safety Commission (CPSC) has issued a warning to parents and caregivers about the use of infant "slings" for babies younger than four (4) months old. Research of reports dating back over the past 20 years has identified at least 14 deaths associated with the use of sling type infant carriers including three reports in 2009. Twelve (12) of the fatalities involved babies that were younger than four (4) months old.

CBS has published the following report:

The CPSC reports two types of suffocation hazards associated with this product. The first suffocation hazard involves newborns, because they are unable to control the movement of their heads due to weak neck muscles. This allows the fabric of the sling to press against the nose and mouth of the newborn blocking the baby’s breathing resulting in rapidly suffocating a baby within a minute or two.

The second suffocation hazard of suffociation occurs where the sling maintains the baby in a curled position which bends the chin in toward the chest. This results in the infant's airway being restricted which limits the supply of oxygen to the infant's lungs. This prevents the baby from being able to cry for help resulting in a slow suffocation. Also several of the babies who died in slings were either a low birth weight twin; born prematurely, or had breathing issues such as a cold or other respiratory condition. Therefore, the CPSC has cautions parents of babies born prematurely, twins, babies in fragile health and those with low weight to use extra caution and consult with a pediatricians about the use of slings.

The USPC has added slings to the list of durable infant products that require a mandatory standard. Additionally, the CPSC is actively investigating these products to determine what additional action may be appropriate. Until a mandatory standard is developed, CPSC is working with ASTM International to quickly complete an effective voluntary standard for infant sling carriers.

CPSC recommends that parents and caregivers make sure the infant’s face is not covered and is visible at all times. If the baby is nursing while in the sling, the baby’s position should be changed after feeding so the baby’s head is facing up and is clear of the sling and the mother’s body. Furthermore, parents and caregivers are also cautioned to be vigilant about frequently checking their baby in a sling.

The CPSC is also interested in receiving incident or injury reports that are directly related to infant slings. Train/Auto Wreck Kills 2.

SALT LAKE CITY - A collision between a car full of fast-food restaurant managers and a light-rail train just south of Salt Lake City Thursday killed two people after the vehicle apparently veered around a railroad crossing arm and drove onto the tracks.

Unified Police Lt. Don Hutson said Friday the 21-year-old driver, Alex Amundson of Fairview, and a rear passenger, 18-year-old Donald Callison of Monroe, were killed in the wreck.

Two other passengers, an 18-year-old female from Salt Lake County and a 19-year-old male from Vernal, remained hospitalized Friday.

All four were KFC shift managers from out of town who were in the Salt Lake area for a business seminar, Hutson said. On Thursday night, they were visiting fast-food restaurants to watch other shift managers in action, Hutson said.

Investigators believe the crossing arms were down and lights were flashing when Amundson drove onto the tracks, said Gerry Carpenter, a spokesman for Utah Transit Authority, which operates the TRAX light-rail system.

"It's uncertain at this time why he chose to enter the intersection but definitely it was a tragic decision," Carpenter said.

The southbound, three-car train was traveling between 45 mph and 55 mph an hour — its top speed — when it hit the Chevy Aveo and pushed it about 300 feet down the track.

None of the 60 to 80 passengers on the train was injured.

Carpenter said UTA crews determined that all of the intersection equipment appeared to be working properly at the time of the collision and the crossing arms showed no signs of damage.

The train's driver is on paid administrative leave and will undergo mandatory drug and alcohol tests as part of normal procedure, Carpenter said.

The crash remains under investigation

Carpenter said it's the first TRAX accident resulting in multiple deaths.

The safest rule of the road one could adopt when approaching a set of railroad tracks (while operating a motor vehicle) is to "Stop, Look & Listen" or at the very least remember to "Look, Listen and Live!"

When gates are lowered, the lights are flashing and bells are ringing, it is foolish to try to "beat" the train by driving through the gated barriers. An average train travelling 55 miles per hour requires a stopping distance of one (1) mile.

Idaho Senate Approves Legislation to Ban Texting While Driving: Bill Goes to the House for Approval

OMG! But the bill wouldn't keep you from making cell phone calls while behind the wheel.

Put away your PDAs.

At least while you're operating a moving motor vehicle on Idaho roads.

The Senate on Wednesday overwhelmingly approved the ban on motorists' texting. It needs approval by the House and the governor to become law.

No more reading, composing or sending e-mails, text messages, status updates on Facebook or wisecracking tweets from behind the wheel?

You know you do it.

Who among you hasn't grabbed a buzzing iPhone or BlackBerry to let someone know you are on your way or running late or stopping at Starbucks?

"I know it will have an effect on me," said Canyon County Sheriff Chris Smith. "I'm not saying I'm guilty."

Drawing from federal definitions, the bill would outlaw any "review of, or preparation and transmission of typed messages via wireless device" while you are driving. Those prohibitions would be added to Idaho's inattentive driving statute.

But don't worry: You - and Smith - will still be able to text or tweet when stopped at a light.

Senate Bill 1352 would enable officers to cite you for inattentive driving if they see you texting, even if you weren't swerving from side to side or otherwise driving unsafely.

The misdemeanor carries a penalty of up to 90 days in jail and/or a $300 fine.

Sen. John McGee, R-Caldwell, introduced the legislation one year after he refused to hold a hearing on a similar bill brought by Sen. Les Bock, D-Boise.

He says he changed his mind because several studies released in the last year show texting while driving slows driver's reaction times as much as having a 0.08 blood alcohol content. Other studies found that two-thirds of all teens and young adults send or receive texts while driving, McGee said.

"Young people have come up to me and asked me to make this a law," McGee said.

The Senate voted 29-5 to pass the bill. The measure now heads the House, where it could face a tougher vote.

This legislation puts texting while driving in the the same category as inattentive driving which is also a misdemeanor. The punishment fits the crime. With the increase in the use of texting while driving, action needs to be taken in order to promote the public safety. I ask all Idaho citizens to contact your Representative in the Idaho House of Representatives and ask them to vote yes on this piece of important legislation. As previously reported, a driver who is operating a motor vehicle while texting is essentially driving while impaired and is significantly more at risk of being involved in a motor vehicle collision.

Drivers Should Exercise Caution & Courtesy When Traveling in Construction Zones

In Idaho, traffic traveling on the Interstate has the right-of-way to traffic attempting to merge onto the Interstate. In construction zones, traffic should observe reduced traffic speeds since fines for speeding are augmented. The purpose of the reduced speeds and augmented fines is to encourage traffic to slow down in order to protect the construction workers and traffic alike since the reduced speeds provides for greater opportunity to avert road hazards present.

Presently, I-84 is under construction in a number of places in the Treasure Valley. When behind the wheel of a vehicle, be courteous and cautious. Even if you have the right-of-way, there's no sense in demanding your space if in the end it's going to result in you getting into an accident. If other traffic has the right-of-way, be courteous in providing enough space so that when you are merging unto traffic on the Interstate that you provide ample space to avoid an incident. Be prepared to adjust your speed while merging into traffic to do so in a safe manner. Make sure that you look over your shoulder to see what is typically in your "blind spot" before changing lanes and/or merging into traffic.

Gerber Legendary Blades Recalls Machetes Due to Laceration Hazard

Gerber Legendary Blades has recalled approximately 149,000 Gerber® Gator® Machetes and 6,000 Gator® Machete Jr. machetes because the saw side of the machete can stick in wood during use, and if the user's hand slips off the handle and slides forward across the machete blade, this poses a laceration hazard. The manufacturer has five (5) reports of individuals cutting themselves while using the Gator Machete, all of whom required stitches. This recall involves the Gerber Gator Machete and Gator Machete Jr. with the original handle (see picture below). Man Dies Pumping Gas After Static Electricity Starts Fire

The Associated Press reports:

HARRISBURG, Pa. — Authorities in Pennsylvania say a gas station patron died when static electricity ignited a fire as he filled up his tank.

Authorities say 19-year-old L. David Byers of central Pennsylvania died early Friday at the gas station in Camp Hill.

A gas station equipment expert says the only other fatality from a static-generated fire was in Oklahoma more than a decade ago.

Petroleum Equipment Institute Executive Vice President Robert Renkes says such fires require a pump without a vapor recovery device and a motorist who generates static electricity during fueling.

Renkes says static is usually discharged safely several ways before a motorist begins fueling up.

Of refueling fires reported, approximately 50% of the cases involved a person getting back into the vehicle while gas was still flowing into the tank. When the consumer returns to the fill area and touches the nozzle to complete the fillup, a static spark can ignite the fumes which can cause a flash fire.

The following are a few suggestions to avoid or minimize the risk of a static electical discharge and fire:

1. ALWAYS turn off the engine before refueling;

2. Before reaching for the nozzle to the gas pump, make sure that the car door has been fully closed and then touch with your hand either the metal roof or metal side door to insure that you are properly grounded;

3. Stay near the vehicle fueling point during the process;

4. Do not get back into your vehicle during refueling even when using the nozzle's automatic hold-open latch. If you must re-enter your vehicle, discharge again the static electricity buildup when you get out by touching the outside metal portion of your vehicle away from the filling point before attempting to touch the nozzle;

5. Avoid gas spills; do not overflow or top off the tank. The fuel dispenser will shut off automatically when the tank is full.

6. If you are filling a container, make sure that you use an approved container. Never fill the container inside a vehicle, in the trunk or on the bed of a pickup or flatbed truck or floor of a trailer. The bed of the truck and/or bed liner act as an insulator as does the carpeting in a vehicle or its trunk which allow static electricity to build up in the container while its being filled.

7. Unlike the video noted above, if a fire commences, leave the pump nozzle in vehicle and walk away from the pump. Notify the station attendant and/or hit the emergency shut off value to shut off the pump. The manuever in the video is an unsafe demonstration of what to do if a fire erupts. The flames could have engulfed the driver when the driver removed the nozzle from the vehicle.

Report Says that Baby Slings Are About to be Recalled Due to Risk of Suffocation

CBS News and The Associated Press report:

The U.S. government is preparing a safety warning about baby slings — those popular and fashionable infant carriers that parents can sling around their chests to carry their baby.

The concern is that infants can suffocate, and a few have.

Consumer Product Safety Commission Chairman Inez Tenenbaum says her agency is getting ready to issue a general warning to the public, likely to go out this week, about the baby carriers.

She did not single out any specific slings or discuss the at least seven reported deaths linked to them.

Safety advocates have cautioned that some slings, where the baby falls into a curved or "C-like" position inside the sling, can lead to suffocation by restricting the baby's breathing.

The U.S. Product Safety Commission has jurisdiction to mandate the recall of products that are discovered to be defective and unreasonably dangerous which pose a risk to the general health and welfare of consumers. This report indicates that at least 7 reports have been made linking deaths of small infants due to the use of this product line. Consumers should discontinue use of the products in question. Once the recall is announced, this blog will publish more information when made known as to which products are involved in the recall and how to return the products for a refund.

Ethan Allen Global Inc has issued a recall of ALL Roman Shades and Roll-Up Blinds due to a risk of strangulation to children. As such, Ethan Allen has added its name to the retailers joining the list of retailers who voluntarily announced in December of 2009 of ALL Roman Shades and roll-up blinds. The hazard exists due to children placing the child's neck beteween the exposed inner cord and the fabric on the backside of the shade or when the child pulls the cord out and wraps it around his or her neck. Also, strangulation can occur when a child's neck become entangled on the free-standing loop. This recall involves all styles and sizes of Roman shades sold under the Ethan Allen brand name. These custom-ordered, made-to-order shades were sold in a variety of colors, fabrics, and sizes. The shades have no labels or markings making reference to the Ethan Allen brand. Why do I work on Saturday and Sunday?

Borrowing from Honda's philosophy, I come to work to "kick out the ladder!"

My mother (God rest her soul) taught me at a young age that I should be responsible and accountable for the things that I do and the things that I say. Safety is no accident.

Hence, the primary reason I am an advocate for justice is based upon my belief that people and institutions should be held fully responsible and accountable for the choices they make that result in creating injury and/or death to others in the hope of helping make our homes and communities a safer and better place to live for our kids and grandkids. By holding those responsible and accountable for the harm they create to others, we provide greater incentive to them to help make our homes and communities a safer and better place to live for our kids and grandkids.

We are a society based upon the rule of law. However, when the laws are not enforced, we become that much closer to a lawless society. More and more efforts are underway by companies lobbying for legislation in an attempt to exculpate, exonerate and/or excuse wrongful conduct. In the end, such legislation takes away the wrongdoer's responsibility and accountibility for the injury and damages they commit as a result of their improper or imprudent chioces. Furthermore, by exculpating, exonerating or excusing such wrongful conduct, we remove an important incentive to those wrongdoers to reform/change their conduct and to make better choices that would reduce the risk of injury or death to others which are important step to helping make our homes and communities a safer and better place to live.

For that reason, I am an advocate of justice. For that reason, I am YOUR advocate.

It is up to each of us to make proper choices that make our homes and communities a safer and better place to live. As such, those who make improper choices that result in harm or injury to others should and must be held fully and completely responsible and accountable for their choices. To do otherwise would simply promote unsafe choices, acts and practices that result in a diminished capacity for our children and grandchildren to have healthy and productive lives; such acts diminish their capacity to enjoy the quality of life.

Why do I work Saturday and Sunday? The cause of justice never rests. Now more than ever people are needed to "work" the problem created by those people and institutions that attempt to exculpate, exonerate and excuse wrongful conduct that result in making our homes and communities less safe to live for our kids and grandkids.

As such by helping me, help you, we all benefit by making our homes, communities and world a safer and better place to live. The work of helping restore the damaged lives of people who have been injured or harmed due to the improper choices of others never stops, because people are human and make mistakes. However, the excuses I have heard spanning over three decades by people and institutions trying to avoid responsibility and/or accountability are numerous. Some Defendants are simply lazy and don't want to make choices or decisions that are perceived to be difficult - they take the easy path which result in others being injured or killed; some people make careless decisions while driving a motor vehicle or performing a service or in designing a product without taking into consideration human factors that would otherwise result in eliminating or minimizing the risk of injury or death; some people or institutions are just outright mean spirited and/or evil in their approach of knowingly interjecting goods into the market place that are defective and unreasonably dangerous but are inclined simply to payoff claims rather than incur the costs of a recall of a product to eliminate or minimize the risk of injury or death due to the use of their defective and unreasonably dangerous product. The later are the worse of the worse insofar as they refuse and continue to refuse to accept responsibility AND accountability for the injury and harm their choices bring to others and take the necessary steps to eliminate the risk.

All in all, the reason I work on "most days that end in a 'Y'"(including Saturday and Sunday) is to help each of us make our homes, communities and world a safer and better place to live for our kids and grandkids by helping you make those responsible and accountable for the choices they made that resulted in your family member or you incurring injury or death. By holding people and institutions accountable and responsible for the acts and omissions they make based upon imprudent, unwise and/or inappropriate choices, you and I provide incentive to them to reform their conduct and help make our world a better and safer place to live.

Wherever I am, whether it is at a location investigating an accident, taking a deposition, preparing discovery (including interrogatories, requests for productions or requests for admissions) or preparing for and/or participating in a trial, I arrive at the destination with the intent to "kick out the ladder" until the job gets done.

I love working as an advocate for justice. I believe my Mom was right. We all should be responsible and accountable for the things that we do and the things that we say, and if and when we make poor choices that result in others being injured or damaged as a result thereof, we should do the right thing and step up and accept full and complete responsibility for those decisions. My life's work and passion has been working cases that are meaningful in not only helping restore some order and function to the lives of my clients but in helping make our world a safer and better place by removing defective and unreasonably dangers products from commerce and/or giving incentive to drivers who are reckless or careless to reform their conduct.

Unfortunately, I find that there are now efforts being made by individuals and/or institutions that are trying to exculpate, exonerate or excuse themselves from full and complete responsibility and accountability for their decisions and/or choices. These are the people that need to be confronted and held responsibile and accountable in order to help make our homes and communities a safer and better place to live for our kids and grandkids. Don't Drink and Drive; Don't "Sex" and Drive

Not only do we have to be concerned about people drinking and driving and those texting and driving but now The Idaho Statesman and KXLY.com report ...

LEWISTON, Idaho — A Lewiston couple escaped unharmed after they left their kitchen for the living room, just moments before a pickup truck came crashing through the kitchen wall.

Lewiston police say a drunken driver was apparently participating in sexual activity with a passenger when he lost control, left the road and drove a 2003 Dodge pickup through the house, coming to rest in a nearby yard. The Lewiston Tribune reports that neither the driver nor his passenger were injured. The driver was arrested on a misdemeanor drunken driving charge.

The residents of the home, Teresa Roesner-Weatherby and her husband, Bill Weatherby, also escaped injury. Damage to the home is estimated at about $50,000.

The obvious moral of the story: Don't drink and drive, don't text and drive and now ... don't "sex" and drive.

Students Campaign for the Adoption Senate Bill 1352 for a Prohibition of Texting While Driving

Texting while driving is reported to be 30 times more dangerous than driving while under the influence of alcohol. Students of Meridian High School have been campaigning for Senate Bill 1352 which, if enacted, would prohibit and make it illegal to operate a motor vehicle while texting. Texting is one of the most dangerous things a driver can do while operating a motor vehicle, because of the obvious - the distraction results in the driver taking his or her eyes off the road which can have catastrophic results.

Some Rental Cars Are Entering Used Car Lots Without Side Airbags

(CBS) Imagine buying a car only to find out that one of its safety features is missing. That's exactly what's happened to thousands of unsuspecting consumers who have purchased the popular Chevy Impala as used cars, reports "Early Show" Consumer Correspondent Susan Koeppen.

The says the Impalas in question were at one time part of a car rental fleet. The safety equipment that's missing is the side airbags.

But, as her team found out in a hidden camera investigation, many of these cars are sitting on used car lots -- up for sale -- with window stickers that claim the cars have those side airbags.

Side airbags are standard equipment on the Chevrolet Impala -- but thousands are being sold without this important safety feature.

On used car lots in three states, "The Early Show"'s hidden cameras found Impalas advertised with side airbags. However, in reality, those airbags were missing, Koeppen reported.

That's was the case when Connie Wittkopp purchased a used Impala from Enterprise in Kansas City. The paperwork said side airbags were included.

Wittkopp told Koeppen, "How could they have a clean or clear conscience knowing that they're going to sell that car to someone who could go out here and get killed?"

Wittkopp had no idea her car was part of a deal where General Motors allowed rental car companies and fleet buyers to delete side airbags at the factory to save money.

Now, more than 100,000 Impalas without side airbags are making their way into the used car market.

Sean Kane, a safety consultant from Safety Research and Strategies, a safety advocacy group, said, "In all the years of our work in motor vehicle safety, we have never seen a standard feature deleted from a car in this kind of way."

Kane said he was shocked to discover side airbags deleted and replaced with plastic. Kane said the effort saved fleet buyers $145 per vehicle.

"This was a concerted effort by General Motors to give fleet customers an option of saving $145 at the expense of safety," Kane said.

Wearing a hidden camera, "The Early Show"'s team went to several used car lots across the country that advertised the Impalas in question as having side airbags. Koeppen said they wanted to see what consumers were being told on the lot.

An "Early Show" producer asked a salesperson if one of the Impalas in question featured side curtain airbags.

The salesperson replied, "Yes, it does."

In Houston, Texas, another salesperson didn't realize the airbags had been deleted.

But Koeppen said her team knew side airbags had been when they found the deleted option code "AK5" on the vehicle identification plate in the trunk. The door trim was also missing the word airbag, which the salesperson eventually noticed.

The salesperson told "The Early Show" team, "This one actually does not have it, doesn't have the side impacts on it."

"The Early Show" producer asked, "It doesn't?"

The salesperson confirmed, "It doesn't."

In Oklahoma City, Koeppen's team found another Impala with deleted airbags, a salesperson told "The Early Show" producer that, in fact, the car did have the airbags. The car's window description listed "passengers front airbag and side airbags."

And in Providence, R.I. the CBS affiliate, WPRI, went undercover with the same result. The salesperson said at that dealership, "They said that there's airbags in there."

Kane said, "To see them being sold in dealers, in many cases unknowingly, is a really a problem that goes back to General Motors."

As for Enterprise, the company offered to buy back their vehicles for $750 over the Kelley Blue Book value, or pay $200 for the customer's inconvenience. Enterprise told "The Early Show" it would give Wittkopp full value for her car, but she's still angry.

"People's lives they're worth a whole lot more than just saving money by leaving stuff off the vehicle," she said. "No, you don't do that."

Enterprise, which admits it incorrectly listed some of these cars on its Web site for sale with side airbags, says, "We have apologized for the error we made, and we have done, and continue to do, what we can to rectify the situation with our customers."

General Motors says these vehicles "meet or exceed federal safety standards." The company no longer allows airbags to be deleted.

Koeppen added on "The Early Show" that General Motors has sent out a message to dealers saying they should change their window stickers, advertising and Web sites to reflect the airbags in the cars.

Koeppen said each dealership was told about "The Early Show" investigation and were told what the teams found. However, she said one dealership still has not changed their Impala advertising.

Koeppen advised, "So if you're buying a used car -- any used car -- make sure you do a really thorough background check on the car."

3. Check with Carfax.com to see what information you can obtain as to whether the vehicle was previously involved in a prior collision and the history of any repairs to the vehicle.

4. You should contact your local department of motor vehicles to ask for a history of ownership of the vehicle. That will help you find identity of any previous owners of the vehicle and then contact same to see what, if any, information they may provide you to help you determine whether you want to take a risk on purchasing the vehicle;

5. Make sure that the seller is providing you in writing with a warranty that all safety devises including air bags are present and functioning;

6. Contact your local Better Business Bureau to see if there are any complaints of record against the seller; and

7. Contact your State Attorney General's Office to see if they have received or are prosecuting any complaints against the seller.

You should never purchase a vehicle without functioning air bags if the vehicle is designed to have them installed including driver's side, passenger side and side air bags.

Ice Rink Roof Collapsed Reportedly Due to Heavy Snow

ROSTRAVER, Pa. — Heavy snow buildup from recent storms likely contributed to the collapse of an ice rink roof, causing a panicked evacuation but no injuries, a fire official and the building's owner said.

"We believe it was excessive weight from the copious quantities of snow that we've had over the past 10 days," Jim Murphy, who has owned the Rostraver Ice Garden since 1993, said Monday. "We believe a laminated wood truss broke and that caused two other ones to go and the roof to pancake in that area."

The region has gotten more than two feet of snow in the past week and a half. Justin Shawley, assistant chief of the Rostraver Central Volunteer Fire Company, also said snow and ice buildup may have contributed to the collapse.

A 100-foot-by-200-foot roof section fell in during a youth hockey tournament Sunday afternoon. The teams were in the locker room and only one person, a rink worker, was on the ice.

The worker heard a crack and told people to get out of the building, Shawley said. About 100 people inside the rink bolted for the exits.

There were reports of people unaccounted for amid the post-collapse confusion, but authorities searched the building with cadaver dogs and thermal-imaging cameras before declaring that no one was missing.

Murphy could not immediately estimate the cost of the damage. He said he hoped to have heat and electricity turned on so pipes would not freeze.

The rink, about 30 miles southeast of Pittsburgh, is in the middle of facility, which was built in 1965, and is flanked by a banquet hall on one side and a pub on the other. Those sections were not damaged, Murphy said. The rink will not reopen anytime soon, though the pub and banquet facilities could, he said.

An investigation in this matter will reveal the cause of the collapse of this building. Albeit heavy snows are reported to be the culprit, the fact is that buildings of the type and kind are designed by architects and constucted by contractors. The investigation will determine if the materials used in the construction of this building conformed with those specified by the architect. The questions posed in this inquiry are whether the materials used in the construction of the building conformed to the design or whether the design itself was insufficient. Conforming merely to building codes are not necessarily sufficient if it is determined that the archetect knew or should have known beforehand what the snow fall is on a 50 yr and/or 100 yr periods. Taking averages over lesser periods do not protect the public safety. Fortunately, no one was injuried in this collapse, but an investigation must be conducted in order to protect others (particularly children) who use facilities such as the type and kind involved in this collapse from potential catastrophe.

Salmonella Outbreak Linked to Black Pepper Sold by Union International Food of California

225 people in 44 states and the District of Columbia are reported by Federal officials to have been sickened by salmonella as a result of an imported black pepper used in the preparation of salami and other types of Italian sausage made by Daniele International, Inc., a Rhode Island company. The recall involves 1.2 million pounds of ready-to-eat salami Jan. 22, after state health officials and the Centers for Disease Control and Prevention linked the outbreak to the company's products. Daniele expanded the recall Feb. 4 to include 23,754 additional pounds of salami products. An estimated 26% have been hospitalized, officials said. Victims of the outbreak are up to 93 years old, with a median age of 39. More than half, or 53 percent, have been male. This is the second time in less than a year that an outbreak of salmonella illness has been linked to pepper. Last March, 42 people fell ill after eating tainted white and black pepper sold by Union International Food of California. The salami, sopressata and other products were packaged under Daniele as well as the Boar's Head and Black Bear of the Black Woods brands and were sold by several national chains, including Costco and Wal-mart and online through Amazon.com. The outbreak began in July and is ongoing. Because the product has a shelf life of one year, federal health officials are concerned that the products remain tucked away in home freezers and pantries. Last month, officials at the Rhode Island Department of Health said they thought the contamination had been caused by tainted black pepper that was used to coat the salami. Tests showed that the same strain of salmonella involved in the outbreak was present in two open containers of black pepper at Daniele's plant in Burrillville, R.I. State officials said Daniele used two suppliers, Mincing Oversees Spice and Wholesome Spices, which both bought imported black pepper. Samples of pepper from both distributors tested positive for salmonella, according to state health officials. "This outbreak only underscores the importance of closely monitoring food that is imported from other countries as they may not have the same food safety standards as we do," David R. Gifford, the state's director of health, said in a statement. The Department of Agriculture regulates salami, but the Food and Drug Administration oversees black pepper and other food additives. An FDA spokesman said that the agency did not know where the pepper originated and that its joint investigation with USDA continues. Daniele, which has suspended salami production, said in a statement it has changed its spice suppliers and will now use only irradiated pepper, which undergoes a process designed to kill bacteria. Salmonella is a bacteria that can cause serious and sometimes fatal infections in young children, frail or elderly people and others with weakened immune systems. Healthy people infected with salmonella can have fever, diarrhea, nausea, vomiting and abdominal pain. In rare circumstances, salmonella infection can spread to the bloodstream and result in severe illnesses such as arterial infections and arthritis. Health officials say anyone who experiences any of these symptoms after eating an Italian sausage should seek medical help.

Huntington Meat Packing, Inc. Expands Recall of 4.9 Million Additional Pounds of Beef and Veal Due to Adulteration

Huntington Meat Packing Inc. is expanding its recall of January 18 to include approximately 4.9 million additional pounds of beef and veal products that were not produced in accordance with the company's food safety plan. This recall release is being reissued to expand the January 18 recall to include approximately 4.9 million additional pounds of beef and veal products, and to correct net weights from 40 lbs. to 50 lbs. in five instances in the earlier release. The products are adulterated because the company made the products under insanitary conditions failing to take the steps it had determined were necessary to produce safe products, the U.S. Department of Agriculture's Food Safety and Inspection Service (FSIS) announced. FSIS has received no reports of illnesses associated with consumption of these products. Individuals concerned about an illness should contact a physician.

The recall was expanded based on evidence collected in an ongoing criminal investigation being conducted by the Office of the Inspector General (OIG) with assistance from FSIS. This evidence shows that the products subject to this recall expansion were produced in a manner that did not follow the establishment's Hazard Analysis and Critical Control Points (HACCP) plan. A HACCP plan describes the process controls an establishment must take to prevent food safety hazards and create a safe and wholesome product. The investigation has uncovered evidence to show that the food safety records of the establishment cannot be relied upon to document compliance with the requirements. Therefore, FSIS must consider the products to be adulterated and has acted to remove the products from commerce.

FSIS routinely conducts recall effectiveness checks to verify recalling firms notify their customers (including restaurants) of the recall and that steps are taken to make certain that the product is no longer available to consumers.

FSIS advises all consumers to safely prepare their raw meat products, including fresh and frozen, and only consume ground beef or ground beef patties that have been cooked to a temperature of 160° F. The only way to be sure ground beef is cooked to a high enough temperature to kill harmful bacteria is to use a food thermometer to measure the internal temperature.

The following safety precautions should be taken when preparing or handling beef and veal products including:

1. Wash hands with warm, soapy water for at least 20 seconds before and after handling raw meat and poultry;
2. Wash cutting boards, dishes and utensils with hot, soapy water;
3. Immediately clean spills;
4. Keep raw meat, fish and poultry away from other food that will not be cooked;
5. Consumers should only eat ground beef or ground beef patties that have been cooked to a safe internal temperature of 160° F, whether prepared from fresh or frozen raw meat products;
6. Color is NOT a reliable indicator that ground beef or ground beef patties have been cooked to a temperature high enough to kill harmful bacteria such as E. coli O157:H7;
7. The only way to be sure ground beef is cooked to a high enough temperature to kill harmful bacteria is to use a thermometer to measure the internal temperature;
8 Refrigerate raw meat and poultry within two hours after purchase or one hour if temperatures exceed 90° F.; and
9. Refrigerate cooked meat and poultry within two hours after cooking.

Helicopter Air Crash Kills 3

PHOENIX — A helicopter crash just north of Phoenix killed at least three people on Sunday afternoon, including a child, and officials couldn't rule out the possibility of more victims.

Residents in the area known as Cave Creek heard noises and saw parts flying off the 6-seat helicopter before it crashed and burst into flames at about 3 p.m. MST.

"I saw the helicopter flying in the air and that stuff that goes round, up, the rotors were coming apart and then I said, 'OK something wrong is gonna happen,'" witness Nicoleta Nork told KTVK-TV. "And I just saw it rolling, rolling and boom, then big smoke and yeah, terrible."

Authorities have specifically identified three victims, said Deputy Lindsey Smith, a spokeswoman for the Maricopa County Sheriff's Office. But since the Eurocopter EC135 can hold six people, officials are looking into whether there were additional victims.

The area is a mix of rolling hills, dry desert washes and lots of houses. The chopper came down in a wash between two homes, Smith said.

"It's a pretty horrific crash," she said. "It's just obliterated."

The debris scattered over hundreds of feet, and deputies were contacting nearby residents to make sure none were hurt and that all the debris was collected for use by investigators. No injuries on the ground were immediately reported.

The helicopter was registered to Services Group of America in Scottsdale, Ariz., a large privately held foodservice and real estate firm. A company spokesman said he didn't immediately have any information about the crash.

Investigators with the Federal Aviation Administration were headed to the crash scene, spokesman Ian Gregor said, and a National Transportation Safety Board investigator was expected to arrive on Monday morning.

There are typically three (3) types of causes for helicopter crashes including, (1) Pilot error; (2) Mechanical malfunction; and/or (3) Electrical malfunction.

I. Operational error.

Most helicopter crashes have been attributable to human/pilot error in the operation of a helicopter. Human error in flight planning, actual pilot control of the vehicle, training and/or improper maintentance. Following any air crash, investigators from the National Transporation Safety Board (NTSB) conduct an investigation regarding the cause of the crash. In looking for operational error, the investigators consider whether there was failure in the operation of the aircraft in accordance with the aircraft’s operational limitations; operation of the the aircraft in unsafe environmental conditions; failure in maintaining a proper flight plan; improper maintenance of the aircraft; improper training of flight and maintenance personnel; faulty manuals, training guides, checklists and operational procedures; and faulty oversight, auditing and review procedures.

II. Mechanical Malfunction.

Sometimes a component of the aircraft fails to function as designed and/or intended. This can happen anywhere along the component’s life due to improper design; inadequate testing; faulty manufacture of the component; inadequate quality control; inadequate operational monitoring; improper installation and/or use; poor maintenance; inadequate lubrication or cooling; and improper installation.

III. Electrical Malfunction

Sometimes a helicopter crashes due to electrical source malfunction or failure, i.e., an electrical source stops working or one of its components has a malfunction. Investigators will consider whether the helicopter crash occurred as a reslt of an electrical source malfunctions; an electrical short occurs; an electrical component malfunction; inadequate design; inadequate testing; inadequate quality control and/or inadequate operational monitoring.

Any and all air crashes are preventable. Typically they are a result of either negligence in the operation or maintenance of the aircraft or due to improper design and/or manufacturer of components of the helicopter.

Honda Recalls Various Vehicles Due to Injury or Death Caused by Defect Airbag Deployment

American Honda Motors Corporation has issued a recall of its 2001-2002 Accord (2 and 4-door); 2001-2003 Civic (4-door); 2002 CRV; 2002 Odyssey; 2003 Pilot; 2002-2003 Acura 3.2TL; and 2003 ACURA 3.2CL, because the driver's side airbag inflator may cause injury or death to the vehicle's occupants due to the airbag inflator rupturing upon deployment allowing metal fragments to pass through the airbag cushion. Consumers should contact their local Honda dealer immediately to replace free of charge the inflator. 2010 Lexus HS250H Added to List of Recalled Vehicles Due to Brake Problems

Toyota Motor North America, Inc. has added the 2010 Lexus HS250H to the list of recalled vehicles in addition to the 2010 Toyota Prius, because customers have complained of inconsistent brake feel after ABS actuation during slow or steady application of the brakes on rough or slick road surfaces which may result in stopping distances being increased compared to customer expectation for a given pedal force. Toyota has agreed to rewrite and recode the programming in the ABS Control Unit of the vehicle free of charge. Owners are encouraged to contace their locate dealer to schedule an apppointment for repairs. The recall is expected to commence in late February and be completed in late March, 2010. Britax “Blink” Umbrella Strollers manufactured by Britax Child Safety, Inc. have been recalled, because the stroller's hinge mechanism poses a risk of fingertip amputation and laceration to the child occupant when the consumer is opening or unfolding the stroller. This recall involves all Britax “Blink” single umbrella strollers. “Blink” is printed on the metal frame on both sides of the stroller, below the hand grips. The recalled “Blink” strollers have model numbers U261813, U261814, U261815, U261816, U261817, U271813, U271817 and U271815 and were manufactured between May 2009 and September 2009. The model number and manufacturing date can be found on a white label on the stroller frame, near the bottom of the stroller basket. Pull Toys Recalled by Manhattan Group LLC Due to Choking/Aspiration Hazards

Pull-A-Long Friends Toucan™, Pull-A-Long Friends Alligator™, and Pull-A-Long Friends Sharky™ manufactured by Manhattan Group LLC have been recalled, because the toys have wooden components that can break, come loss and pose a choking/aspiration hazard to young children. This recall involves three types of pull-toys: Pull-A-Long Friends Toucan™ with lot code 210720GB, Pull-A-Long Friends Alligator™ with lot code 210750GB, and Pull-A-Long Friends Sharky™ with lot code 210530GB. The Toucan has a large yellow and black beak and blue striped wings. The crocodile is green and has a red ridge on its back and red wheels with yellow polka dots. The shark has blue swirls painted on its wheels and an orange wooden fish on the pull string. The lot code is printed on the bottom of the toy. Consumers should immediately remove the toys away from young children and return them to the store where purchased for a refund or a replacement toy.
